Stick with it Tony.....I did and they settled (in full) out of court with me, after initially defending the action with their generic defence of we don't owe the claimant anything. I hope you remembered to claim interest - it may be little now, but could add up before its settled.
One tip - remember to submit your cashback claims as normal pending the outcome.
When I submitted my MCOL, 2 cashback cheques (numbers 1 & 2) were received the morning after I submitted the claim:D0 -
The two cases may be different. If one was on a price-match deal and the other is based on non-receipt of automatic cashback it may be dangerous to assume that the outcome will be identical. Like the t&c, each case may be very different and should be treated on its own merit.0

does anybody have a template for issuing a MCOL for all cashback based on non reciept of automatic cashback?
I am issuing my tomorrow evening but am feeling lazy so if there was one I could copy and paste that would be great.0 -

Update to my MCOL: E2save made me an offer via email to settle the claim out-of-court, but this was for the failed Autocashback, Month 6's payment, and as a goodwill gesture to pay the £25 court fee. I immediately responded back to them and asked them to revise the offer to something more sensible, as I wasted time & effort (and p&p) sending the claims which were not fulfilled.
I received a follow-up offer with a further £20, but they refused to pay out anything for the future. I replied back saying that I'll accept the full cashback + £25 court fee, and deduct £25 from the compensation amount o £50 that I've put through.
They said that they are not willing to budge on their second & final offer, which is non-negotiable. Have replied back saying that I reject their second & final offer, and look forward to going through the legal channels to recover the full amount now.
Hope that I've made the right decision0 -

I accepted their initial offer, then applied for my next cashback, which was refused.
So am now at the stage where I have issued a second MCOL on the same contract.
I think you have done the right thing, as you would have ended up taking them to court a second time ...... like me.0 -

Sorry to hear that your next cashback was rejected. Have e2save told you why it was rejected?
I am tempted to accepting it, but will be interesting to see if they pay the full whack that I'm entitled to in advance. If they were responding to my emails prior to this dispute, it would have all been resolved so much quickly and better for everyone.
They were replying back to my emails within a few minutes today. Amazing what a court letter can do!0 -

Previous cashbacks not claimed correctly. They were replying back to my emails within a few minutes today. Amazing what a court letter can do!
Again, same for me, do an MCOL and they communicate, apply for cashback and get silence.0 -

Yes, good idea! Did anyone write one before which can be shared with others please? I am sure a lot of people will appreciate and benefit from it.0 -
Claim for the FULL chequeback of £xxx. The Automatic Chequeback of £xxx was due in (Month), and £xxx due in (Month). I contacted e2save several times for the Automatic Chequeback of £xxx, but was ignored.
e2save have fundamentally breached their TnC's of not fulfilling the Auto chequeback. I hereby submit an additional claim of £xxx for other expenses, which includes postage, call charges, and compensation for inconvenience caused.
e2save have been given advance warning of this claim in writing with reference to my leter dated (xx/xx/xx) Tracking Ref: xx xx xx xx xx GB.
(This is short and brief as MCOL doesn't allow a long explanation. It's worked for me fine, so hope it helps others.)0
