If the cheque had arrived yesterday would you still have issued the MCOL?
If so, carry on, if not, then ring the court first thing on Monday and they will cancel the claim and send you a cheque for the full fee paid.
Im just looking on the cheque, it was issued on the 7th May, my LBA sent 29th April would have reached them 30th April, so strictly speaking they did pay in 7 days, however, am I right is saying that it's irrelevant as they still breached contract which was to sent auto chequeback within two months, which was 5th April.
Im tempted to keep the MCOL as it will save a lot of messing about with the cashbacks that I will still need to make in the future, but can I still win ? If so, do I send back the cheque I recieved or just deduct that ammount from what Im claiming ?

I don't think you can win, 7 days is pretty short (7 working days or 7 days), and they will claim they made the effort and it arrived within 7 working days. I always give them 14 days, then wait a few more as there is no hurry on my part.0 -

Them sending you just part payment won't affect your chances of winning.
You can bank the cheque, and proceed with the MCOL, you will be able to amend the total outstanding during the course of the MCOL.0 -

Actually I only asked for the auto chequeback ammount in the LBA...but I thought that was irrelevant since they already breached the contract by not paying within the 2 months.0 -
Ahhh...... they have responded to your LBA - and paid what you asked them for.
If you wanted them to pay you the whole amount because of their breach of contract (or else you would take them to court), then that should have been stated in your LBA.0 -
Damo1888: The t&c are easily found when ordering at any given time - including now. Anyone finding THAT difficult really shouln't be doing these deals. The Price-Match deals ended last year - that also suggests you should not be going for these deals until you do a LOT more research. It's all on these threads for those who care to look.
As for unfair terms - I wouldn't be too optimistic of my chances in court if THAT was all I relied on.0 -

I've just finished my second cashback contract with Dial-A-Phone, so I'm not new to this sort of thing at all. At least Dial-A-Phone actually send out the PROPER redemption claim dates with your phone and tell you EXACTLY what you need to send off, to the PROPER address! If any of your claims are invalid, it doesn't invalidate future claims. You also get your cheque within a week of sending your bill off to them. If you decide to change tariff at any point, they don't charge outrageous prices to allow you to do so and it also doesn't invalide your claims. A far, far more reputable company than this E2Save.
The only reason I'm considering touching these people is because of the £1.99 for 400 texts and 500 minutes a month deal as opposed to Dial-A-Phone's £10 for the same tariff.
You say the T&C's are easily found when ordering at any given time, does that mean you see the T&C's before committing to buy?
Are the T&C's a PDF document? Are the T&C's the page that pops up after clicking 12 Months £1.99 by redemption?

Yes, yes and yes. One dealer's t&c have nothing in common with any other - or their own at different times (except when cpw companies stole a competitors' t&c a year ago. NEVER take out ANY cashback deal with ANYONE until you know precisely what you are doing with IT. All the answers and guidance are well documented on here for those who are prepared to put in to the time and effort. If you aren't (AND willing to keep up to date at least daily) steer clear! Of course, you could follow the long line of people who have dealt with these companies in the past and never had a problem... until the last 12 months when the IIC took over (read the threads if you don;t know about the IIC).0

Apologies if this stuff has been covered before or in another thread - I have tried looking....
I took out a contract on Orange with E2Save in August 2007, it's a 12 month contract and the email at the time said I should submit the sixth bill to get the first lot of cashback. The sixth bill was the January one and it was rejected for not having the original telephone number on the bill (I'd ported my old number over.) I phoned E2Save up. I was told to resubmit the bill and write on it that I'd ported the number and I would be sent the cashback.
Six weeks later and I hadn't heard anything so I phoned up and was told I should have submitted the February bill, but I was too late to do that; but as it wasn't a cashback offer I could submit subsequent bills (i.e. eighth, tenth and twelth) on schedule and still get that cashback. At that time (early March) I went onto the mycashbackclaim website and it said "Send month 6 claim in Jan 2008". So I've been exchanging correspondance with E2Save on this matter and had my March bill rejected this time receiving a letter saying it was submitted too early. I've now sent them a LBA and given them two weeks to pay up.
However last week I went back in to the mycashbackclaim website and it now says "Send month 6 claim between 23rd Feb 2008 and 23rd Mar 2008" - they've changed the flippin' dates! :eek: I've got the original email and printout from March, so I don't think they've got a leg to stand on, but I guess this is a warning that you should get and keep a printout from that site asap. Has anyone else spotted them fiddling around with the claim dates on this website?
Secondly I took a different contract out with E2Save with O2 in Feb 2007. I forgot to submit the September bill until it was too late. I thought that subsequent claims would also be rejected as I'd 'broken' the contract, but I submitted them on time anyway just in case E2Save dropped a clanger. No cheques appeared. Whilst discussing the situation above I was told by two different e2save employees that subsequent claims would be honoured. I then asked about this 02 contract and was told the last two claims should have been paid and it's only the price match offers that a missed claim invalidates any further claims. Is this correct or are the e2save staff mistaken?
