Good luck:) Fight the good fight!
Thanks AMF i will be posting updates on my case on that link as well!0 -
I sent off my first claim on the 12th March via Special Delivery and it was delivered on the 14th March as it was re-directed.
When should I expect to receive an email or a cheque? I understand I should only allow them 14 working days to laod details onto system and 28 working days from receipt to process.
Do I just sit back and wait??0 -

Settled out of court and paid court fees!
Well done:beer:
Can you fill us in on a little more of the detail please? Did they meet your claim in full (all cashback due)? At what stage was settlement reached (did you get as far as filling in the Allocation form)?
I've completed the Allocation form following CPW filing their generic defense of "We don't owe nothing. Honest guv!". I've learned today that the judge has struck out their defence and ordered CPW to file a defence answering the specific claims by 28 March. Hopefully I'll be following your example in the not too distant future:D0 -
I took out a contract on 10/01/2008 via e2save. I have not received my automatic cashback within 2 months. I am about to write an LBA. If I do take them to the small claims court can I sue for just the automatic cashback amount or the full 12 months cashback, as they have broken the T&Cs.0
-
Thanks, keep us updated on how you get on.
My first auto cashback is due by 22nd March and not received as yet.
It would be nice to get all cashbacks early, but wait for result of LBA first, give them a chance to sort it - after all it may have been a genuine miastake

Paid all outstanding vouchers, and agreed dates for 2 remaining vouchers.0 -
If you claimed the full amount, then why agree dates for them to pay out "remaining vouchers"?
They know when they attempt to settle out of court that if it went all the way you would win.
Best to refuse any settlement offered which is less than the claim. If they are trying to settle with you, they know they would lose. (Though if you have claimed interest, then, just maybe that could be a "cheap" negotiating item you could throw in - as in "pay me my claim in full, and I'll let you off the interest you owe me")0 -
When using small claims
1) Always appear to be reasonable and co-operative.
2) Always try to make the other person look unreasonable and obstructive.
Magistrates look unfavorably on the unreasonable and obstructive and often award against them.0 -
What do magistrates have to do with it?
Judgement in county court cases is based on the appropriate laws. Nothing to do with any subjective issues.
There is nothing unreasonable or obstructive in refusing to accept any offer from the defendant which is less than your correct, reasonable, (and paid for) claim.0
