This has to be precise and concise and not simply say, I am in hardship according to the Lending Code because my first reaction to that would be, why?
You have to explain your individual circumstances to them, ok?
They had all this in writing but still threw it out.0 -
just read the new info and copied this from itThe date range that can be used for this is not as wide as the previous law. This piece of law applies to all new charges from 6 April 2007, and to people who had charges before April 2007 providing the borrowing was still outstanding on 6 April 2008. It also may not apply to accounts closed before April 20070

This meant I incurred additional living costs as I still paid the mortgage and had to rent a flat. IT was not long after this charges started being applied to my account. Then I managed to patch things up in the March with my wife and we got back together. Then in the April my mother in law died which meant we had to find all the funeral and burial costs (my wife is an only child). More costs, more charges, further into debt. Then without discussing it, Nationwide reduced my overdraft limit. Again this caused more charges.
They had all this in writing but still threw it out.
This may seem an odd question but did you contact the bank during that time with regards to your situation and any of the creditors where the arrears built up?
Do you have utility arrears and mortgage arrears?
Did you speak with the funeral home with regards to paying off part of the balance in monthly payments?(yes, I know it can be done but not sure if you had that option open to you?)
I think my gut reaction is that you need to take this to the ombudsman which I believe you are doing.0 -
hi
i recently tried to reclaim more credit card charges from 2 credit card companies, i had already claimed charges back from both 2 years ago but have since accrued more charges, 1at one was with MBNA who gave me back my full cliam of £112, next one was with Egg who say they have already paid me for previous charges and therefore say they are not paying me back for this cuurrent claim, is there anything else i can do0 -

I have to re-do my hardship expenditure and income.
How can I find out how they judge it?0 -
how come you have to re-do it ? The judge it in same was as the debt companies and people like CCCS etc. Priority debts and essential living costs then see what the left over is (if any).LegalBeagles0
