Check the t&c's of your insurance contract. Most mobile insurance contracts allow you to terminate the contract, some charge a small fee towards this, but at least ur out of contract.

They could not stop you using another handset, unless you were using it for say business on a personal tarrif. If they tried on the basis that you were using an alternative handset to the one provided, it is very likely that the court would deem this an unfair contract, especially if you could prove the old phone was defective, as you would not be able to use a service you were paying for.

I wonder whether to put this to the test. I've been told in two 3 shops (Poole & Bournemouth) and in Phones4U Chippenham that if I buy a contract with phone and use the SIM in another (3G) phone, they'll track the IMEI and block the SIM. The trouble is, I fear that having been told this before I take out the contract would mean that I couldn't claim against them. However, if I just bought online they wouldn't be able to ask and wouldn't be able to warn me in advance not to do it (anyone know if there is anything in their actual contract about this??). I really don't understand what difference it makes to them, as long as it's a 3G phone. All the guy in Poole would keep saying was "you won't have the Planet 3 software on your phone so you won't be able to access the internet." I said why can't I use Opera, as I do now? But he wouldn't or couldn't answer that.

Three are honestly the worst company ive ever had the misfortune to deal with.

They are rude arrogant and unhelpful. They will tell you anything if it means keeping you hapy but in reality what they tell you will be lies.

Three family members all had three phones in a period of about two months all the phones stopped working. 3 said this was due to water damage. I don't think so three. My V3X has just stopped working (terrible phone) and I know they will just label it as water damage
    Merry Christmas MSE!

I can honestly say I haven't really had any bother with 3, and of all the networks(except Vodafone, which I haven't tried) in the areas I need it to operate in, it's by far the best and most reliable coverage. How do I know??

Because I'm working away from home, and am carrying 4 (?!?!) mobiles around with me !! Works one on O2 (not too bad), plus PAYGs on Orange (third best, still too patchy) and T-Mobile (worst of the lot - even somewhere like Edinburgh !!) and my trusty LGU880 on 3, which gives me by far the best and most reliable coverage :D

BTW - if you think I'm sad by carrying 4 phones around, bear this in mind - we're in the process of relocating, and while we were househunting Mrs GunJack's phone (on T-Mobile) was losing signal constantly. Good job the contract's up in October, we thought, but which network will be the most reliable where we are going to live ?? Answer - try them !! Hence me walking around with 4 of the 5 major networks on the go, and so far 3 is still looking the best of the bunch. Obviously this will depend on where you are in the country, but for the places I need to go to and will be living in, 3 is coming out on top.

p.s. - anyone got a spare PAYG Voda SIM that I could try...just for completeness, you understand !!!

The only problem there is that the different phones may have different performances. If they're all unlocked you can swap the SIMs round randomly (except I don't suppose they're all 3G phones)! Also note that Three has a backup 2G network so in a way it has an unfair advantage.

gromit - the orange and T-Mobile SIMS are in unlocked 3G phones, and the O2 SIM is 3G also, so Ive being trying as many possible combinations as possible - only U880 and works Nokia are locked, but how can you say 3 have an unfair advantage??? - good sense I call it, and long may it continue.....

...still want to try a Voda SIM, though...

Looks like you've got that sussed then. I only say unfair in that they had to sign an agreement with another carrier in order to be viable while still rolling out their network, so you effectively have the choice of two with Three. Presumably at some point, this agreement will end, and then the coverage might become more patchy.

I am on three was persuaded by their sales team to transfer to them from vodafone. The tarifs seemed cheap so signed a contract with them. Since being with them have had to call customer services a few times for one thing or another. Their customer services are crap, which i feel is an overall factor when considering what company to go with. Cheap is great but cheap customer services can make you feel like your banging your head against a brick wall at times. so will change mobile phone providers when i can.
