    XL trading have allegedly been watched very closely firstly by various economic crime units until it was passed on to various forces including SOCA who got involved for reasons unknown.If found guilty they would be sued for the full RRP of every game and music cd sold and also an inevitable lengthy jail sentence.Sky,sony and microsoft amongst others will be wanting to set an example as to warn others of doing the same thing.

    Good Morning people... oh look - looks like we are alive and well this morning :)

    We are not going into in-depth again which we have been doing for the past couple of days but here is the basics again.

    1. We are NOT pirates
    Pirates sell on carboots and make a mass profit from doing such - hence they are arrested and shutdown.
    We, DO NOT support piracy although a lot of people on here would like to think we do.
    The service we provide is that of a duplication service, which you ARE allowed to do under UK law - someone cannot make a backup copy of this themselves, we can do it for them HOWEVER.. we make only an operating profit of around 30p on each game item sold and this is down to the costs we incur doing this.

    2. We are NOT bedroom pirates - again, you are posting such idiotic things which are again potentially libellous and truly defamitory to our site.
    You do not have any kind of proof whatsoever that we do such a thing - nor could you prove it if you did. We can state quite clearly. that we again ARE not pirates.

    3. The details on our WHOIS are for our ex business partner - no longer with us, which do need to be updated, we are working on this as we speak.

    4. It is posted that we have mentioned getting games before release dates - this is true, however.. the legal side behind that is that we do import a lot of stock from overseas where the release dates differ from ours.

    5. We HAVE NOT been contacted by SOCA, FACT or any other trading standards unit in regards to the site.. we would indeed speak to them direct if they did to allay any fears they may have.

    6. The Sky cards
    We get them direct from Sky, we pay Sky for the privilige of them - and everything is above board. We are not legally responsible for how clients use the cards as stated in our T&C's

    7. Premises/Contact Details
    We have taken all of your info on board and we will be updating this shortly

    8. We do not know anyone called Gary Cooper
    Please explain this to us :)

    People in 'the know' clearly do not know as much as they think they do on here.. and false rumours about being investigated by SOCA and FACT are clearly embelished.

    We have not been investigated by ANY economic crime units so your post is defamitory at best.

    Again, chinese whispers - which people are 'ill informing' others about once again :)

    I am interested in people that are reading this thread are thinking - because from an outsiders point of view, they maybe are looking in thinking there is a lot of false accusations, and a lot of waffle that has NOT be proven, a lot of basic lies from people on this thread claiming to 'know something' and a lot of chinese whispers that we have been banned.
    All of it NOT true as you can see :)

    From the case of Mr Modchips a while ago (if you have not heard of this, please google search for it) the purpose of supplying a modded console for backup purposes only seems a quite legitimate thing at the moment.
    I believe he won his court case because the simple fact was, he was not aiding piracy... the people who have purchased said modded console MIGHT - but Mr Modchips was not.

    Quite clear in T&C's which clients MUST agree to when ordering from us.

    We can offer console mods.. a lot of people do... and are still trading I might add :)

    Therefore, the argument that the back up is legal has no weight when they are offering to back up a game that does not even exist (ie, is still being pressed at the factory).

    Games - have a release date- we all know this correct.
    Certain suppliers however in the UK, not mentioning names because they are big companies, supermarkets and other retail outlets not especially gamer shops have been known to sell out of release date games to customers - which we believe is naughty of them to do so (they can be fined we believe)

    This is how we receive games out of release date OR we import a version in from either the US, or further afield dependant on the region of the game.

    Please do a google search for release dates for games being broken and you will see what I mean :)
    Nothing illegal by doing this - we have been sold a copy before a release date, hence we own that copy.
    Run by a laddy in Sheffield (from his bedroom?) who goes by the name of Timothy.

    So becuase YOU own a pre-release copy then that allows you to sell, at a profit, unrestricted copies of that disc to others who have not purchased or own said pre-released software?

    Your own T&C state the purchaser must have an original of the game before buying a back-up. the obtaining of pre-release disc is small, if not, miniscule in numbers and yet you are prepared to sell to anyone on the basis that if the customer says they have an original then that is fine by you.

    And seeing as you are now back with us, can you please qualify as to why you are exempt from companies act and EU website/distance selling acts?....and seeing as you are Mr Wikipedia - some links to confirm your view point would be good as it would silence all those who believe otherwise. Nothing better than the truth to win an argument.

    You ought to be ashamed of yourselves. At least the person you are attacking hasn't sunk to your incredibly low level, it speaks volumes for him and nothing for you [nearly all].

    Sky are rightly proud of their very successful and profitable business. They have an extremely secure viewing product. Most of you probably don't know that a big contributor to the failure of ONdigital/ITV Digital was that that their viewing cards could be replicated/copied/forged by anybody with simple instructions and a very small outlay on hardware. I know because I was in their technical department.

    Now given Sky's might and success in rigorously keeping their business model secure, consider this... Why on earth would XL Trading still be in business? Sky have pursued many individual Pub Licencees for abuse of Sky Sports. It is now being suggested towards the end of this thread that XL Trading are maybe utilising a legal loophole to make money.

    Do any of you notice that Martin proudly notifies all subscribers of loopholes all the time so that we may all benefit?

    Now ask yourselves if you haven't been just a tad unfair and abusive towards XL Trading.

    To XL Trading, all the best for your continued success.

    And no I don't know him/them. I currently pay Sky £17.50/month but have paid much more in the past. I'm in no need of XL Tradings product. Good luck to all who use their/his services.

    I actually think that MSE would be happily rid of you abusers of the forums but daren't criticise you for fear of a backlash. But that is just my opinion.

    I last posted sometime ago and advised people not to bother replying as I wouldn't even bother reading them. The same applies here.

    We do not sell for a massive profit - those are pirates you are talking about.
    Please do not think we sell on carboots or like any of those people you are talking about - because we would not go those people to buy from (sorry if people do this at carboots... nothing personal)

    You seem to be missing the point I have made many times over the past few days.
    Clients MUST ALREADY own the game BEFORE they can use the service.
    They signify this by ticking the release box before an order.
    If they have ticked the box, they are agreeing to a legal disclosure which allows us to duplicate for them.
    Quite simple really.

    And if they already own the disc EVEN if out of a release date, a duplicate can still be made for personal use.
    INCIDENTALLY, we can also provide clients OUTSIDE of the UK under the same T&C's

    I still think people believe we make MASSIVE profits out of everything in the store???
    WHY would be still doing this if we made massive profits... surely we would be living the high life somewhere you would think and not posting on MSE.
