So as Jason said they can copy a game and sell it on provided you own the original even though its not out yet. That's okay is lawful then.

If as there web site suggests its perfectly lawful to provide backups I am sure its not lawful to do it as a profit which @ £3.50 certainly is given at best it should be less than £1 per disc and you can get copies from various places of course illegal but at least they are not ripping you off unlike these clowns are at £2.50+ per disc

I wonder if the tax man knows as sometimes mass pirating involves other crimes some of these are tax avoidance, benefit cheats, even drugs in some cases etc etc

I hear they are about to get raided ;)
I heard Sky have consulted a top legal firm who specialises in this and also several movie distributors have got involved.

Copyright law is a bit weird. In very simple terms you are allowed to back up computer software for backup purposes only, provided you have the original and provided you do not circumnavigate the copy protection (and if you do circumnavigate it, it is also okay but it is illegal to sell such copy protection removal services/equipment so if you've downloaded X-Copy or similar then that is fine but X-Copy will be in trouble for selling it to you).

It is outright illegal to copy CD and DVD's and you are not allowed to circumnavigate any copy protection - this is the difference between software and CD/movie DVD's. Clearly it is much more complicated than that but this is poste for those not in the know to get the general gist of the law.

    Hi,

Just a copy of my previous post in case it has been lost!

XLTradingUK asked for legal proof that they have an obligation to provide a full geographical address on their website.
    Here you go....
    http://www.opsi.gov.uk/si/si2000/20002334.htm

Regulations 5 & 6 list who is exempt from abiding to DSR's. Non limited companies or sole traders are not listed.
Regulation 7 informs sellers they must provide a legitimate geographical address of contact if they take payment for goods in advance.

You asked for legal proof: the document on the link IS legal proof. Time to get a geographical address on the website if you wish to continue trading legally.

Their T&C's on the last two lines make it very clear that you need a modded console and that they (XL) do not sell modded console - becuase that is illegal under copyright law.... and yet there website menu clearly shows that they offer console mods

Maybe they employ same lawyer as our friend Gary Cooper ;)
  • It appears the user XLTradingUK has disappeared.

Kicked out by MSE or closed account under pressure?
