You seem to be missing the point I have made many times over the past few days.
Clients MUST ALREADY own the game BEFORE they can use the service.
They signify this by ticking the release box before an order.
If they have ticked the box, they are agreeing to a legal disclosure which allows us to duplicate for them.

You seem to be missing the point XL, your website appears to be in contravention of the companies act and some EU web/distance selling rules. As an aside, I note the address you use at Google checkout is NOT the same as where your business is located - why is that?
Your blog also makes reference to pre-release games being available to rent and I wonder what part of copyright law allows you to do this as the subsequent commercial use of a product is strictly forbidden in law - you couldn't even play a CD in a GP surgery without permission and payment to the rights holder.
Explain.
And if they already own the disc EVEN if out of a release date, a duplicate can still be made for personal use.
But the chances of so many pre-releases being in the public domain is minimal and yet you were still renting and selling back-ups beforehand.
INCIDENTALLY, we can also provide clients OUTSIDE of the UK under the same T&C's
Bear in mind that the interpretation of EU coipyright rules are different between each member state, some countriers are not part of the EEC and places like America have their own take on things.
WHY would be still doing this if we made massive profits... surely we would be living the high life somewhere you would think and not posting on MSE.
Becuase that is how people make money - they do something and get money in return. We can only conclude then that you do this as a charitable venture then and that you are providing these goods at cost to the customer. Not exactly a business model the Dragons would want to invest in is it :-
1. Obtain legal copy of game for £30
2. Copy it to 100's of people, using hundreds of discs, labels, postage - make no money from this.

But they cant be VAT registered otherwise they would of commited another OFFENCE by not stating it on their website.

You ought to be ashamed of yourselves. At least the person you are attacking hasn't sunk to your incredibly low level, it speaks volumes for him and nothing for you [nearly all].
Sky are rightly proud of their very successful and profitable business. They have an extremely secure viewing product. Most of you probably don't know that a big contributor to the failure of ONdigital/ITV Digital was that that their viewing cards could be replicated/copied/forged by anybody with simple instructions and a very small outlay on hardware. I know because I was in their technical department.
Now given Sky's might and success in rigorously keeping their business model secure, consider this... Why on earth would XL Trading still be in business? Sky have pursued many individual Pub Licencees for abuse of Sky Sports. It is now being suggested towards the end of this thread that XL Trading are maybe utilising a legal loophole to make money.
Do any of you notice that Martin proudly notifies all subscribers of loopholes all the time so that we may all benefit?
Now ask yourselves if you haven't been just a tad unfair and abusive towards XL Trading.
To XL Trading, all the best for your continued success.
And no I don't know him/them. I currently pay Sky £17.50/month but have paid much more in the past. I'm in no need of XL Tradings product. Good luck to all who use their/his services.
I actually think that MSE would be happily rid of you abusers of the forums but daren't criticise you for fear of a backlash. But that is just my opinion.

XL trading i was told who you really are and also where you reside but you are entitled to your privacy.All your bank account transactions,web activity,mobile phone records and virtually everything would have been compiled to form a case before they can proceed.I have passed on your messages to someone that you wish to speak to the relevant authorities to claim ignorance but as always ignorance is no excuse.Bring this thread up in a few weeks and see what your opinion is then.0

I don't know how legit you are, but you're certainly putting up a spirited defence.
The only comment I will make is that, if you're selling working(?) SKY cards, there is only one place they can originate from and that is SKY. Their encryption system has not been hacked and unlikely to be.

don't bother with this, bought one of these a few months ago and it never worked and i have since asked for a refund without getting one no matter how many times i email the so called "company".
Always told I am being passed onto a different part of the company. Basically putting me off so I won't get my refund.
Once I had half given up on a refund I asked for another card and they told me that Sky had stopped sending them cards so couldn't send me another one. Yet again I've been told lies as this is here.
Would love to hear what his excuse is when he see's my post here because I am fed up emailing the guy.
My opinion is he is a guy operating out of his bedroom and he has no intention of ever refunding me my money but rest assured I will be posting this on any other website that I see chatting about his so called offers because if he is this so called legit business then why am I not entitled to my money back. Of course he can prove me wrong by refunding me the money he so readily took from me to begin with.0 -
