Thing is though overdrafts aren't regulated by the consumer credit act 1974 so the provision for requesting proof of a CCA does not apply.

And even if it did, lack of a CCA would only prevent the bank in question from enforcing the debt in a court of law, it would not prevent them for recording defaults on the customers credit file - so in this instance, from either angle, it's a dead end I'm afraid.

If I were in your position united66 I'd just pay them off. At least then you'd stand a much better chance of approval for a Vanquis card and Capital One Classic in six months time so you can start to rebuild :o

Izools, thanks for your reply. Don't want to keep this thread off topic so just thought I'd make a quick reply. I would like to repay the defaults but I'm not sure who to write to at Santander and Natwest respectively. If they have sold the debts to DCA's then do I pay the DCA's?

Why do you need to write to the lenders why don't you just phone up natwest and santander tell them your ready to pay your debt,if they have been sold on then ring the company which has got your debt and then pay them over the phone.
    Job done.

United remember if you decide to pay the defaults will still be on your file, just shown as settled which makes little difference to your "lendability" on older accounts. Although if you are borderline for say vanquis or the like it might just push you over. If they are close to falling off your credit rating ie nearly 6 years since default you could just wait until they fall off.

Mind you, you will probably feel better knowing they are cleared and at least it stops any debt collectors moaning down the line at you.

Unless you were posted a deed of assignment / notice of assignment then the debt is still with the banks.

I would suggest writing to them agreeing to pay the full outstanding balance on condition that they remove the defaults in their entirity from your credit file.

Some may agree, others may not, but it's a step worth taking before handing over your cash.

    Good luck! :o

They are both pretty new defaults one is 2009, one 2010 i think. I'd like to pay them off to be honest but I haven't got 700 pound cash lying about to pay them off im an only worker with a fiancee who doesnt work and a 7 month old son.

Well, according to the tool it's certainly worth a dabble. It's more accurate now as it collects data from Equifax AND Call Credit when working out your chances :o

  • Does anyone know if its just call credit or equifax as well, when they do the initial "eligibility" check?

I got 80-90% for the Barclaycard Initial half an hour ago? My equifax report is ok, dont know about call credit, and my experian report is good.

    Any ideas anyone?

I only applied and got accepted for Cap1 4 months ago though? not long enough?
