should I go for MCOL or send a letter, properly this time, via MCOL?
MCOL won't send a letter for you.
You need to do this yourself before commencing with MCOL.
As already posted:Don't embark on a county court action before first sending a Letter Before Action. Ordinary mail will do.0 -
I am not sure too whether it was a good idea to send LBA in normal post. The reason to send LBA via recorded delivery is to cover your back so that CNM don't complain that they didnot receive LBA and therefore didnot have a chance to rectify mistake before legal action (knowing them they wouldn't havedone it anyway). This may go agianst your case.
A L.B.A through the normal post is fine, as you should have correspondence to show that you are in disagreement before the L.B.A.
They have the chance to pay you once they receive the summons in any case, so they have no reason to appear in front of the court if they are in agreement with you, so you won't need to show anyone you're being reasonable.
I send L.B.A's by normal mail, I send two from separate Post Offices and obtain a "Proof of posting"(Free :money: ) from each.Well life is harsh, hug me don't reject me.0 -

LOL - wish the promoters of coolnewmobile goodluck in their despair attempt to become millionares by running cash back scams. No doubt, they will either end up in jail or a sanatorium some point  . HA HA HA
I lost £2.50 with coolnewmobile for attempting to order a phone via their internet channel.
After that, never got tempted going for any cashback phone. My old contract I signed around 8 years go with vodafone is still running fine...600 minutes for a tenner, no tariff upgrades. The downside is - no x-net mins. Thanks Lynsey, bunch of scumbags i'll nail them yet !0 -
I'd rather pay 70p and have the confidence that they can't claim you didn't send one (proof of posting not being proof of delivery) than queue up at two post offices!
You do not need proof of delivery, as I said earlier, if you have been in dispute with a retailer you should already have sufficient correspondence to show that you've given them an oppurtunity to correct their error.
You of course can pay for recorded delivery, but despite what you say, recorded delivery has not got proof of delivery if it is not signed for.;)
So what you have left for your money is 'Proof of posting'.
I was a postman, and I can guarantee that you that lots of companies do not sign for recorded delivery(For retailers such as this, nothing positive is delivered by RD) I was often told to "Send it back".
So I would say that you have more chance that they will receive and read at least one of two first class letters than one recorded delivery.
If the court hinged on them reading a letter, I can assure you that my method would win hands down compared to an RD letter that frequently is received by a company without the need for signing.
When there's hundreds of pounds at stake, I don't mind queueing for 5 mins at a post office. :AWell life is harsh, hug me don't reject me.0 -

I didn't say proof of posting was proof of delivery - the process of checking the website for proof of delivery is so obvious that it doesn't have to be said - something that with proof of posting you never get.
We're going around in circles, can I say this one last time.
You don't need proof of delivery.:)Well life is harsh, hug me don't reject me.0 -
I believe you only need to show that you sent the letter before action (via free certificate of posting from the Post Office) to be seen to have acted reasonably in the eyes of the court.
Having said that, I normally send my claims by Special Delivery and my LBAs by Recorded Delivery.0 -
Sounds like you've needed to send quite a few of them! Lol!0

Agentsmith can I ask how you did this ? Did they offer you to reinstate the claim and just pay the 1st claim like they did with others first ? which you declined ? and then they paid out in full ?0
