    RajaStyle - if you are certain you complied with the conditions, then it is CNM who have broken the contract (not you).

    So even if they do make you an offer to reinstate it, why would you want to accept it?

    It just means you have to return to submitting claims and allows them more opportunities to not pay you.

    You have no reason to accept any compromise from them. If it were the other way round (eg you hadn't complied properly with conditions), and you were trying to negotiate/plead with them (by suggesting they refuse one instalment, but reinstate the remaining ones), what do you think their reply would be?

    Your right Quentin, does anyone have the claim form before it changed to include the 'handset despatch note' ? Would very much appreciate a copy !

    3rd claim off today. Hope to get this one and then I can relax. Anything else will be considered a bonus, but if they stay in business I will get the lot. I'm not relying on it though !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    thanks everybody for all the solid, excellent replies...but...uhh :/

    shock! i got a letter from PBD :j. i asked them to send a copy of these forms that i'd supposedly filled in incorrectly...thought i had them by the balls because they wouldnt be able to comply...

    but they sent back some fuzzy copies of both forms.... which appear to show me !!!!!! up both forms as they had said.... I am tempted to be insanely paranoid and assume they doctored the form prior to printing it ou... (never know :()...of course it's also possible that i am THAT stupid, and wrongly filled in a simple form not once but twice... I mean really, why would I write PBD then only the last 3 digits of my reference number.

    oh well, good thing i didn't bother throwing any money away with an MCOL...haha :/

    best of luck to everyone on here who has a legitimate gripe with mobile affiliates, and have a better chance of victory than me. Listen to the people on this forum! They know! Also photocopy your claim form before sending it off; then atleast you'll be sure, unlike my dumbass :beer:

    I'm sorry if this question has already been answered.
    I took delivery of a phone from Cool New Mobile on 6 June 07. The deal was for 12 months at £35 per month on Vodafone, repayable by cashback in full by 5 equal payments. The T and Cs sent to me at that time made no mention of sending the despatch note. However their current website says you should send the despatch note with the first claim. Should I send it with the first claim or would doing so actually invalidate my claim?

    tim, the T&C's weren't changed until the end of June. If you printed off your claim forms at the time (around 6th June) the form would not have asked for the "despatch note".
    If you printed off the claim form of late, then it will. In that case it would do no harm to send it as extra info. Send a forwarding letter stating why you are sending the despatch note if you want and keep a copy, in fact keep a copy of everything.

    Sending it "Shouldn't" invalidate your claim.

    Put in a covering letter saying that you know it isn't required but are doing so so they can verify your details.

    The law requires you to follow the terms and conditions that you signed up to, these will be the ones enforced by the courts.

    hi,

    i have recently been rejected by CNM on my last claim of 73.50. the reason given was:

    'Claim form was incorrect as there was no signature - therefore you have invalidated your claim'

    i am sure that i would have signed it, if there was a field for signature. however, i didn't make a copy of my form. this is the only reason given, i assume all other doucment/proof are fine.

    even if i forgotten to sign, i don't think it is fair, do you?

    it does seem CNM are declining a few claim recently. would it to do with my decline?

    gtmoon, that's why everything needs to be copied, especially with this type of trader.
    You got me checking mine again there, but all looks ok.
    I can only suggest contacting Trading Standards/Consumer Advice or another legal expert who can advise and clarify if you have a case.

    Right - due to loads of stuff happening in my life lately I've still not persued moneyclaimonline! (Silly me.)

    But there has been a development.

    I've JUST received 4 cheques for 4 of the 5 lines I have with CNM. This is WAY after what their original TnCs stated of "payment within 1 month" - in fact it's been more than 2 months since they received my original claim!


    I sent the claims on the 4th of July - for which I have a special delivery slip. This was received by CNM on the 5th of July.


    I received a "we have received your cashback claim and are sending out your cheque within 10 days" email on the 27th of August! This was more than 1 month after the claim was sent out to them in the first place!


    The Cheque received today and the letter attached to it is dated the 18th of September!


    The envelope in which the cheque was sent is postmarked the 1st of October!


    Cheeky !!!!!!s! :mad: :mad: :mad: So somewhere down the lines their "efficient processing of mail" means that it takes a cheque 14 days to get from the top of someone's desk to an envelope. I'm not bloody surprised these claims mysteriously go missing!





    I've already sent them my 2nd claim forms via special delivery [heh, I even videotaped myself doing the entire thing] which arrived at CNM on the 20th of September so today's cheque dated the 18th of September MUST be the 1st cheque out of the cashback redemptions.




    What do I do now? Do I not bother to cash these in claiming that they're already in breach of their own TnCs and persue a claim for all 5 accounts? Or do I cash these in and continue a few more months of CNM redemption servitude and just claim for the 1 contract whose page "mysteriously" went missing?

    I've only opened 2 envelopes - the other two are still sealed and SHOULD show the same information.
