    How much did cost you to pay for the claim for MCOL? also there's been a mention of claiming the interest on the money. Could anyone advise me on how much to claim interest or how the interest in calculated?

    I have had my 2nd claim rejected for £84. In total I have to claim £336.

    So what's the full amount do I have to make a claim on with the interest and the MCOL fees?

    Please help!

    If you have grounds to claim the whole amount from the original contract, then claim the £336.

    The fee for that is £30. This will automatically be added to your claim.

    You can claim interest for any money overdue.

    You are shown how to do it when completing the (very user friendly) MCOL form.

    You calculate the interest on a daily basis from the date the money should have been paid up to the date of the claim.

    If your claim is successful, when you ask for judgement you then get the opportunity to add the further interest that has accrued since the claim was first issued.

    It's 8%.

    It is all explained by the system as you complete the MCOL.

    Read the claimant's guide first to get the full SP.
  • Rajinder, click on the link I have pasted below. It takes you to Citizen Advice Bureau information leaflet which explains how to calculate interest. You need to work out the number of days since the claim money became overdue till you issue the claim on MCOL.

    The fee for a £300 to £500 claim is currently £50 although this is reducing to £35 at 1st October (see http://forums.moneysavingexpert.com/showthread.html?t=559759 )
  • I am furious, I took my contract out in March 07, sent my first claim off in August 07, they wrote to me 4 days ago declining my whole claim and l am out of pocket £420 due to the fact no 'handset despatch form' was included. There was no mention of this when i took the contract out in March, they changed the document in July and terms of claiming and have denied me all my money ! Without any communication of even changing the t&c's ! Is that legal ? Would I have any luck taking them to small claims ?

    Which claim form did you send?? The early one's didn't ask for the despatch note.
    Have you a copy of the T&C's at the time of order?? These can still be obtained if you haven't.
    You would have all the luck you need in sueing, as long as everything else is in order.

  • Join the club.

    They cannot change the T&C's that applied when you took out the contract. Your Claim Form that you downloaded at that time would not have listed the dispatch note as a required document to send with your 1st claim.

    Write to them and give them 14 days to put right their mistake, post recorded mail. Tell them if you have not had a satisfactory reply within that time you will sue and carry out that action.

    Read this thread for similar problems and action taken.
