  • If it's about practicalities and not the rest don't do any of these deals! I'd have thought tax breaks were an integral part of the decision making process for investments - not a be-all-end all. Of course, the government is quite happy to renage on its promises so maybe we should ignore the rest? In which case I wouldn't have a single mobile contract or nice new phone - that alone about a dozen in total. That would also mean my friends and family who used to spend £20-£20 per month on payt without a decent phone would also be worse off? Yes, each to their own; which is why it is never a good thing for the crusaders to try to stop everyone else having the choice!

    As for the networks - they are no worse than most other organisations in this country - and often somewhat better! No-one forces anyone into these deals; those who rush in blindly ask for the trouble they get.

    I do agree with much of your last paragraph. If these forums weren't so successful not so many would succeed and the deals would still be good and easier to do. It was always obvious to any idiot that if everyone got all their cashbacks the deals couldn't exist. Therefore an enormous amount of care and consideration needs to be taken beforehand (which was why I waited well over a year before getting my first contract and spent a lot of time looking into things - and dealers - during that time).
  • just an update on my moneyonline claim. I have recd a letter saying 'mobile affiliates ltd' intend to defend themselves. THey have 28 days to do so.

    Hopefully this is just another delaying tactic, and as previously posted they will 'contact' me to pay the outstanding and reinstate my contract. fingers crossed

    It is not a good idea to do a deal on the phone with a Defendant when they have received a summons. Ask them to write to you.

    If you have paid for a claim for the full amount owing, and they want to just pay the outstanding instalment and reinstate your contract, then that is a good deal for them! They have more opportunities to renege.

    It was them that breached the contract, not you, so why would you want it reinstated?

    As long as you stuck to the conditions, then their fundamental breach means you can go for the full amount originally agreed.

    (If you only claimed the amount overdue, and they agree to pay your claim in full, then you still need them to put in writing that they will pay all future claims arising out of the original contract).

Also, i think that if they do want to defend the case, they have no grounds really as they are 100% lying and their defence would be based on pure deceit to the claimant and to the court. Just hang in there, you know you are honest and I will not get worried about the defence bit.

    In agentsmith's case it doesn't look as if it even got as far as a judgement.

    I've only used MCOL once and as as reported this led to CNM paying the disputed cashback and reinstating the contract.

    However on the MCOL website I could have entered either Judgment by Default or by Admission although obviously in my case neither of these apply. Do you know how this bit works?

    I understand your point regarding legal precedent but if they are paying the full amount, especially if it was their initial response, it strikes me that they are clearly admitting their 'error' and this is a useful negotiating precedent.

    If they paid you the full amount claimed on the summons prior to you getting a judgement against them, then the matter is closed. (No judgement by default or by admission)

    If they ignore the claim, then after 14 days the claimant can ask for "judgement by default". The Defendant gets ordered to pay the claimant.

    If on receipt of the claim, they officially admit the claim (on a legal document), and ask for time to pay, (or payment by instalment etc), but the claimant is not happy with the proposal, then the claimant can ask for "judgement by admission". The court decides how the defendant is to pay, and issues an order.

    the letter came from MCOL, so seems standard procedure. given the fact that cnm is saying it never recd one of my pages, i would fully expect them to use their rights as by MCOL to pay at the last allowed minute!

    i have been encouraged by this forum and the userfriendly aspect of MCOL. hopefully good news to follow.
