Agentsmith, it is really good news. Did they defend the case or not? I have served the summons to CNM, they have until 6th October to respond (14 days). Also, what are you doing about enforcement? Any information will be useful and welcome.0 -

they said they would defend it, then settled out of court. Cheque arrived the day the papers are processed (around 1mth from when I first filled out MCOL).
The cheque arrived, and it's cashed now.... unless it suddenly bounces then it's enforced. Im waiting for this to happen before closing procedings with MCOL.

I assume this was the whole cashback you successfully sued for? (rather than just the installment rejected).
Didnt they try and offer you just the installment in the first instance? Did you persist and go for the lot?0 -
You fill online money claim for whole cashback, interest, court fee and other costs.

i did not send in my second page in my first claim. now all my other claims are invalid. does any one know if this is illegal? i am thinking of taking them to small claims court as the T&C did not specifically say subsequent claims. This is something new on their website.0

It's not new. All the usual mistakes. If you can't even be bothered to KNOW what the t&c you signed up for were (and PROVE it - which you can't because you plainly didn't keep a copy and are completely wrong!) and failed to read all the warnings on this (and other) threads I'm afraid there's no point in complaining about what you THOUGHT were in the t&c four months ago! The ONLY issue is whether you were obliged to send the whole bill. That was (and is) also covered in the t&c. If you were and didn't you can't complain; if not, sue and get all the cashbacks in one go (don't ask - it's all on here too).0

These are probably the T&C's you subscribed to below;
Cash back claims are available to customers by redemption that subscribe to a brand new 12, 18, or 24 month service agreement where all payments are up to date and paid in full. Cash backs are claimed by sending us the original claim form, correctly completed. We send this to you by email when you purchase your handset. Along with the claim form, send us the original airtime bill showing your name, address, mobile number and tariff. You receive this by post from your network operator. We do not accept copies or online bills. We only accept one claim per envelope. Your name, address, mobile number and tariff must be shown on the bill, we will not authorise any claim where this information is missing or the bill has money outstanding. We therefore recommend that you pay your bills on time and do not cancel or take a summary itemised bill from the network. If it is your first claim and you have ported your number in from a previous supplier you must also send your first bill showing the original mobile number we supplied to you.

Wow... I haven't checked the forum in months and was astonished to see all the problems you guys are having with CNM.
I've just recieved my final cash back payment,
meaning a whole year of free calls :j but have opted to not risk it for another year and have gone directly to Orange for a safer deal.
I wish you all luck with trying to get CNM to cough up your cash back at small claims court.
Just one tip to all you guys who are still sending in claim forms....
Obviously send recorded delivery and when you hear nothing from them, which is inevitably the case, send them an email with a link to the royal mail and your unique royal mail reference. That way they have all the infomation and proof to hand imediately.
I did this every time and on every occasion I had an email the same day from CNM confirming that they were dispatching a cheque that day.
About 3-5 days later i had a lovely cheque for £72.00

Forgive me if I'm being dim; I can follow terms and conditions as well as the next person, but this bit in the T&Cs has me confused - "or take a summary itemised bill from the network." I've just received my first bill which consisted of one page only. I suppose I'm a casual user, so I don't have a summarised bill. It does however clearly state my name, address, telephone number and tariff. I had originally thought this would be sufficient, but that line has given me cause for concern. Do I now need a summarised bill?0
