To give you long suffering CNM customers some hope, I was waiting for my 4th cashback cheque for well over 2 months and after reading post 855 by 'Dinosteveus' (sorry tried but can't do quote thing), on the 18th Sept I sent an email to claims@mobile-affiliates.co.uk, containing links to this thread and the moneyclaim site, threatening legal proceedings if the cheque wasn't received within 5 days.Guess what ? I got an email reply the same day apologising for the delay and the cheque arrived today (20th) !!. It was attached to a letter dated 3rd September so it was obviously sitting around waiting for me to chase it up.The letter also advised me that I could make a further £10 by recommending friends and family to Coolnewmobile !! You have to admire their cheek don't you - I wouldn't recommend my worst enemy to these guys !!Anyone wanting the content of the email (courtesy of Dinosteveus) please PM me.Good Luck0

iabw12:- I suspect that means an internet bill rather than a paper one, but I agree; it's the most ambisuous thing in the t&c and made me think about it a good deal too when I first read it (a LONG time ago!). However, in law you have sent them (or will be sending) a bill which shows all the specific things they list and is a paper bill. I would be quite happy to sue for ALL the cashback if they turned me down in that situation!0

I have received acknowledgement of my claim, let's see what happens next?0

Long wait is what's next - to drag your money out as long as possible OR to give you no chance to correct anything which is "wrong" with your claim!0

I've just come to the end of my current O2 contract via Mobileshop.com - cancelling is a nightmare with O2 but that's another story  - and I have had delays and hurdles to overcome to get my cashback, but have always (eventually) achieved them.
I've been searching & searching for advice about alternative suppliers offering cashback - not only because of the problems encountered with mobileshop but mainly because they don't have the deal I want.- My conclusion is that all these deals/companies are as bad as each other.
- The chances are you'll get your money - eventually - if you are persistent and willing to go to court
The fact that we get a 'free' phone (sell on ebay), moneyback via quidco or similar, plus cashback should be viewed as welcome but additional bonus.
That we, the subscriber, can get a free phone, free calls, free texts and potentially make a profit on the deal is amazing so we shouldn't be surprised if it takes a little bit of effort.
Yes, these companies should abide by their own contracts - and as we see, can be encouraged to do so - but in the final analysis, if you don't get any of the cashback, you'll still only be paying for the priceplan you would have chosen anyway
...that's the MSE way isn't it? Choose the product that suits you, is vfm, then see if you can get some additional deal.0 -
I'd like to thank everyone on this forum who've contributed. I am a victim of this scam where I was told that I did not send in my full bill and that the Page 3of3 which is the tarrif page was missing which I am sure I did send in as I keep all photocopies of the documents I send in.
This has encouraged me alot and I am definately going to fight and make sure I get my cash back claims full.
Thanks alot esp Bob!!!
thumps up!!!

langtoft_lad - I totally disagree. I wouldn't have a mobile phone or contract if it wasn't for the free deals. Now I have so many I don't use my land line for outgoing calls. To regard the cashback as some sort of "bonus" is entirely wrong. If you bought a car with a five year warranty and the wheels fell off two monhts later, would you be happy if the dealer failed to honour their contract just because you got the car you wanted? I don't think so...
I fully intend to get ALL my cashbacks as that was the entire deal as far as I'm concerned. The phone and bundle are extras to me; I have lots already. I am saving a lot of money for a few friends and family too - and would NEVER accept them losing out because a dealer failed to pay when they did things correctly (and I make sure they do!).
Quidco spouts a similar line with things like insurance, where it's possible to get massive cashbacks. According to them people shoudn't take the cashbacks into account when purchasing, yet the size of the incentives make a fundamental difference to which product you buy - otherwise the companies wouldn't offer them! It's completely ridiculous and unfair to be promised certain VERY tangible benefits and then be denied - for whatever reason. Further, if that was acceptable it wouldn't be possible to hold the phone dealers to account in the courts.0 -
Good luck Raj, don't let them get away and issue summons after your LBA. I have already served them my summons and I will fight back to get all the cashback money.0

Each to his own point of view Mobilejunkie but in the same way one shouldn't choose a investment or savings product based upon the tax breaks or the shareholder benefits, I don't believe we should choose a mobilephone contract based upon third party cashback offers - especially as we now know how shaky a financial footing most of them are on and also how tricky it is to get the refunds.
It's not a question of morals or contractual obligations - its about practicalities.
Further random thoughts:
Perhaps some of vitriol should be directed at the mobile service providers themselves? After all, it must cause immense difficulties when they keep changing their commission structures & bonus payments.
And whilst I'm not saying its right, if as has been suggested their business model is founded on a percentage of customers not claiming then I suspect facilities such as this forum contribute to some of the problems we highlight. A sort of vicious circle. As we help each other to successfully chase up claims, the more unstable their financial condition.0
