interesting reading, this legal stuff...and excellent support here on these forums
i'm considering making a claim via MCOL as phoneboxdirect still haven't replied to my letter.... obviously i will talk to the citizens advice bureau (or get other legal advice first) but just want to have the options in my head
they're already owing me money.... and i'm just concerned about spending £30 (i'm on a budget here) on the claim if i'm not sure i'll get it back.... i know i'm in the right, but not sure i'd have all the legal ins and outs down. i'd hope they'd just settle without it going to court...... have they actually challenged (m)any in court? Like the poster said above, this receiving a claim and deciding to defend it...is this just a delaying tactic? that'd be great
I'm still owed multiple instalments...if I do go the MCOL route, do I claim just for the most recent one that they screwed me out of, or the whole thing? I haven't sent the most recent one off yet, so they havent had the chance to mess me about...that's why i'm not sure

What email do I use to get in touch with CNM about missing cashback? I've used the contact form on their website as I couldn't find an email address that accepts incoming mail. Is that ok?0

You don't, you send it in writing. Emails don't really stand up (they can say they never received them and they can be altered) - much better to send a letter by recorded delivery and keep a copy for yourself. Give them one chance if you want and then LBA, but with CNM you may as well go straight in with the LBA.

I've been down this route, although not (yet)? with CNM, when my first clainm was denied by another company. I filed via MCOL for the whole amount, plus court fees and plus the extra money it cost to send copy bills. My claim was acknowledged, and was "defended" by the company in question. I held my nerve - like you, I had followed their T&Cs to the letter, and I wasn't prepared to take it lying down. A court date was set, but they decided to settle out of court by sending me a cheque for everything I had claimed. IMHO if you honestly feel you have adhered to their T&Cs, then don't back down. Yes, there is a risk involved, but as you haven't received your cashback - you would "only" loose the court fee's if it all went terribly wrong. I suppose the basic question to you is - How much do you want to pursue this claim?

My personal circumstances are that I don't use my mobile that often - so much so that payg would be cheaper than a contract if I didn't get 100% cashback.
My contact via mobileshop.com has just ended, I have a month or so to wait for the final payment. As they are considered to be one of the best payers & yet have been slow paying recently - I've decided not to take out another contract at the moment as I think that these deals at the moment are not worth the risk.
However, if the free calls/texts bundles make getting a contract worthwhile & economic value, then of course I'll go for a cashback deal because getting any money back - even if it takes a bit of effort & hassle - is better than none.

The consensus here is that you should go for all outstanding cashbacks plus the court fee.
Agentsmith managed to get them to pay all this amount saving any future hassle.
Others of us have settled for the refused cashback and reinstatement of the contract (as CNM had said that all future claims were null and void)

If you end up having to use a warrant to get the money for your claim, you cannot use a PO Box Address for them.0
