    Just to let people know that the Moneysupermarket price comparison site have given notice to CNM(think PHONEBOX Direct as well but not sure) that they will not be allowed to have ads placed in their comparison tables. They have already been removed from the 'Best Buys' section. Not sure how long notice is clear all ads is.

    There is a forum relating to CNM on the Moneysupermarket site if anyone is interested.

    My position is same as many others who have had the 'not received' twaddle from this Mob.

    I have issued a County Court summons against CNM(Mobile Affiliates) and the Court has received an acknowledgement from them . Not lost in the post!!!! They have about 20 days to post a defence/pay up or I will be able to obtain a Judgement against them. I can then enforce the Judgement by various means.

    Can any of the people lucky enough to receive a cheque remember what bank the cheque was drawn on?? It may be helpful to me should I need to enforce judgement.

    The chq's i recd where all handwritten from natwest bank.

    By the way I have written (recd delivery) to cnm about 12 days ago giving them 14 days to answer my query/pay me my cashback as I did not leave a page out etc etc.

    If I have not heard from them, I want to go ahead, like you, with the small claims court. My question is as I need to claim for my 4th c'back, should i also claim for the 5th c'back and all the postage and legal costs?

    what did you claim for? tks for the help in advance.
  • I thought it was HSBC but it could've easily been NatWest - I didn't hang on to it for long enough - went straight intot he bank!

    it was a Natwest bank cheque. Please keep us updated about the claims court action as this will be my next step now. Also I am not sure either of how much to ask for in compensation?

    Thanks for info re chqs folks. Handwritten?! Obviously don't feel need to invest in the facility to print out cheques as they don't anticipate producing many!

    If someone could let me know the Sort Code and/or account number on the chq it would be really helpful.

    With regard to Small claims Court I am chasing them for the first installment due, £73.50. The total claim is for £103.50 to include £30 issue fee charged by the Court. It quickly became apparent what this lot were about and I decided not to mess about. In a nutshell I have all the proof I need so they can't win the Court Case. Enforcment will be the only problem which is why I am trying to get bank details above. The website you need is www.moneyclaim.gov.uk

    People are at all differen stages of their cashback claim. Personally I would not mess about waiting and being fobbed off. Reason one is that I am owed the money now and I want it now. Reason two is that this lot might go under so I am giving myself a better chance of getting money prior to them going belly up.

    You will have to make your mind whether you want to go to the expense of using the small claims' proceedure. Up to £300 claim carries a £30 issue fee. Over that the next tier £50 I think. If you win the case you will get the fee back, it is part of the claim. The online proceedure is really straight forward(you don't need to go to your local Court to issue proceedings) and I doubt you will need any help. If you feel you do need help then go to your local Citizens Advice Centre.

    My decision was simple. They took great pleasure in telling me that my entire claim was invalidated because they had "not received" my initial claim. This meant that I stood to lose £367.50. The £30 fee seemed extremely reasonable in these circumstances.

    My next claim is due this week. I will send it and give them 28 days notice to pay. If they don't they will be getting another summons totalling £103.50 on the 29th day!!!

    I know that Martin is always on TV saying shop around online to get these great offers, but invariably you end up with the wrong package based on the perceived cashback you will or will not get and the headaches that go with it.

    The networks love it is they are more likely to get paid, as you have the carrot dangling in front of you to get your money back.

    Go to your local reputable independant dealer, get the right phone on the right package for your needs, and a better service, and stop chasing the carrott.

    If you cannot afford loads of minutes and loads of texts then just use the phone less, and do without the stupid offers that make thse people richer, and you invariably poorer.

    You will also walk out with paperwork and contracts that detail what you have signed up to.

    Apart from online banking, i try and purchase items from genuine retailers (usually small companies) whom will give me a good service, not just then but in the future as well.

    If everyone heeds Martin's advice, then all that will be left are Large Retailers, or Online, where you can expect to have future headaches if things go wrong.

    Yes, it may cost slightly more, but i prefer a good service and the back up that i require in the future.

    My PC's and Computer equipment are purchased from a local Independant shop, who are always available if i am having problems, or general advice.

    My Kitchen equipment is purchased from a local Euronics franchise, whom know thier products, and have steered me in the right direction of paying a little more to get better quality products that will last longer than cheaper products, and are also there quickly if a problem arises.

    If you do want these money saving deals, i hope they don't cost you dearly in the future. :rolleyes:

    This was claim 2 of 5. The Company in question claims the second page of the bill was missing, this fact is not disputed.

    Under dispute:

    A) The time it took for them to identify the missing document and then
    inform (over 2mths - outside of claim window).

    B) By their own admission they 'missed' this fact (A) during their
    check on 26/6.

    C) As a result of their inability to inform me of a problem within a reasonable time (over 2months) all subsequent claims are invalid. Meaning a shortfall of £336

    D) the missing page detailed the tariff held. I summise that Mobile Affiliates have access to this data as they impose penalties on those who change tariff within 180days.

    Since the claim was sent the same day the bill was received (11/6) and Mobile Affiliates signed for this on 12/6, that left nearly a full month for any subsequent communications to solve the problem.

    They failed to inform within the timeframe because they failed to scrutinise the documents carefully enough on the 26/6 (whilst still in claim window)

    I just compared wifes claim form, with the one on their website right now.

    Interesting part is they changed the wording from:

    "...showing tariff charges and number"

    to:

    ".. showsing name, address, tariff, and number"

    ... so we sent them a t-mobile front sheet which showed the tariff charges..., it just doesnt display the tariff. My interpretation of this, is that since we sent it off on the claim sheet provided when she took out the mobile, that we are clear. (the original statement above)...

    Yes. Someone else spotted this earlier in the thread. Your interpretation is correct: you agreed to the T&Cs when you took out the contract, and they haven't made it clear to you that they have changed them.

    PS best to trim the quoted material (down to nothing if necessary), and post your message after what you're quoting.
