As for the CCJ comment. How many CCJs have been raised total against mobiles or CPW? its ok listing 20 of them on a forum... the inidivual ones are not releveant.

How many per year are the CCJs raised?

Then take that number and divide it by total number of customers a year..... multiply it by 100 and you get an idea of what percentage CCJs to mobiles.co.uk customers that is..

2 CCJs, ever, neither related to a redemption issue.

    I believe that makes 0% :)

The only update to our site/T&Cs we've made in the last 2 years is to add a sentence saying that the cheque may arrive up to 28 days after we request it, as a result of feedback here on MSE.

For clarity, because I know people are going to argue with this post, we say it takes up to 30 days to validate and send the cheque and then up to 28 days for it to be delivered by the company that handles that side of it.

I am sorry, but your t&c don't actually say this. I have reproduced what they do say below
Your cheque will be sent within 30 days of us receiving your claim provided you are eligible and we can verify the claim. The cheque will be issued in the name of the account holder. Receipt of the cheque will normally take up to eight days to allow for printing and postage time. However, please allow 28 days for delivery of your cheque before contacting us.
Now the first sentence is unambiguous and 100% clear. "Your cheque will be sent within 30 days etc...............". No mention of your instructions to a 3rd party who will then take another 4 weeks. It says "sent" not "requested"

The bit in bold please allow 28 days for delivery of your cheque before contacting us does not imply a further 28 days - on the contrary it implies concurrency. Not even the Post Office takes 28 days to deliver mail.

Where is there any reference to a cheque handling company "For clarity, because I know people are going to argue with this post, we say it takes up to 30 days to validate and send the cheque and then up to 28 days for it to be delivered by the company that handles that side of it."

I know it must be difficult to read all the negative posts about your company and there is a distinct being tarred with the same brush because you are a CPW subsidiary, but anyone who is in the least bit impartial will find it very hard to support your defence of the current wording of your t&c if the reality is actually what you have written in your reply to me.

Why not put what you have written in your t&c so that any confusion, bad feeling etc , not to mention the huge waste of time for your customer support execs having to deal (or ignore) customers who are chasing their cashbacks after waiting 30 days, can be avoided?

    Those sentences boil down to;

"Your cheque will be sent within 30 days"..
"It should take 8 days to arrive"..
"Please allow 28 before chasing it with us"

To me this makes sense, but (at the risk of offending MJ and Quentin with another update!) I'll rewrite that section today so it's as plain as I can make it.

    Thanks,

No it is not. Dishonesty is never fair. Not fulfilling a contract is dishonest. If you can't see that, then no point in arguing with you.

Not settling within the contracted timescale (late payment) is one thing. Denying receipt of trackable claims (see numerous other threads) is another and is 100% dishonest.

    ..and doesn't relate to Mobiles.co.uk, I feel I should point out :)

I'm not going to speak for Carphone Warehouse, only Mobiles.co.uk. We are a separate company, owned by CPW but managed independently from our own premises.

We've never been taken to court over cashback, not one single time.

Well I've taken you to court......!

Brilliant. That would be a real step forward that would inevitably save your company a lot of phone calls and bad publicity if you make it as clear as your posts here.

If you do, I hope Mobilejunkie, Quentin et al will join me in a positive post for your efforts.

    Thanks.

Previously you said "thank you" when it was pointed out that you and your ts + cs weren't singing from the same sheet.

Now you revert to CPW type sarcasm!

As previously posted, savvy customers will have printed copies of the ts + cs which were in force at the time of purchase, and will rightly expect you to stick to them (in the same way that you do should a claim arrive late).

    A) That wasn't related to redemption cashback,
    B) You lost,
    C) We were awarded costs, which you haven't paid (and we haven't pursued)

In fact, MSE have removed posts where you claimed to have won after we demonstrated the above, so I'm a little surprised to see you bringing this up.

    I don't think I'll be commenting further.
