the time scale slipping a few extra weeks is not a major problem..

Perhaps it wouldn't be if it worked both ways.

If they can't stick to the timescale for sending us our money, then in return do you imagine they would let us send in our claims a few extra weeks late?

    Those sentences boil down to;

"Your cheque will be sent within 30 days"..
"It should take 8 days to arrive"..
"Please allow 28 before chasing it with us"

To me this makes sense, but (at the risk of offending MJ and Quentin with another update!) I'll rewrite that section today so it's as plain as I can make it.

    Thanks,

Just checked your web site this morning - changes to make it unambiguous don't seem to have been made yesterday as per your post.

I updated the local version where we make all of our changes, which goes live in about 90 minutes.

Anyone following the problems experienced with cpw companies will know they cynically change ts + cs regularly.

So if you didn't do it at the time of purchase, just 90 mins to get your print offs of the legal ts + cs which apply to purchases made before today!

We've changed our T&Cs twice in 5 years, and both previous versions are still available on our site, and all I'm doing is letting people know that cheques take 'up to' 28 days to arrive (as I said, I think it's more like 8) after we have confirmed validity (which currently takes about 7 days). So in fact, people are getting their cheques within about 15 days of claiming currently.

Didn't you accuse me of being rude when I said that I was updating the cashback FAQ page "even though it would offend Quentin"? You can't have it both ways and be upset when the page doesn't mention the time the cheque takes to arrive, and then upset when I edit it so it does.

You simply do not understand what you are talking about and it's very tiring having to keep coming back and explaining why you are wrong; why don't you let me help MSE users and PM me if you have a query about one of my statements?

    1) No, I never accused you of being rude, though elsewhere you have made this apology to others for your posting style:
I apologise if I come across as rude

    2) But accusing me of "not understanding what you are talking about" is hardly the language expected from a company rep.

    3) How am I wrong. I have pointed the way for you to check that your suspicions that cpw companies have not been taken to court over late payments, but you went silent over this!

    4) I have correctly advised people to keep a copy of their ts +cs. You say that previous ones are available on your website, though that is not the case over today's fudge over "Your cheque will be sent within 30 days of us receiving your claim"!

    5) Being an authorised company rep doesn't mean you have free access to us all and cannot be publicly engaged in discussion!

Thanks for your input, obviously we disagree about certain things and there's not much to be gained by continually going back and forth about all this.

I happen to think we are the fairest online mobile phone retailer you'll find and there's abundant evidence of this just in this thread, but you're of course welcome to your opinions.

MobileJunkie has a mobile phone from us evidently and I actually take this as a good sign that we're doing OK - seeing how he wrote the definitive guide to cashback, he obviously put his faith in us.

    Have a good day.

    Bit of a "cop out".

    You post:

    1) "You simply do not understand what you are talking about "

    2) "you are incorrect about pretty much everything"

Then when I challenge you about these inflammatory statements with chapter and verse over matters you wrongly assert to be true (eg cpw's ccjs, you have kept an archive version on your site regarding your change made to your cashback ts + cs today, your accusation I called you "rude", etc etc), your patronising reply is to voice your opinion that you are the "fairest" mobile phone retailer, "have a good day".

The readers of this thread will be able to make up their own minds.

Not with regard to your cashback ts + cs which ofcom say contain "unduly restrictive ts + cs"

eg. Ofcom say you should give us at least 60 days to submit a claim. You only give us 30.

Ofcom say it is wrong for retailers to refuse to pay just because there is an outstanding balance on a customers phone bill. You won't pay cashback if the account is "not up to date".

If a customer stops paying their bills then the network will claw back our commission (which obviously funds the cashback). It's not fair to the business to expect us to pay cashback where there's an obvious indication a clawback may be imminent, and of course the cashback is designed to refund bill payments that in this case have not been made. Do you not think this is fair?
