there is no mention of the phone being returnable in the case of a cancellation . I would call the manager back and say there is no mention of the phone being returnable if the contract is cancelled according to section 8.4 of thier t&c
Yes you are right. Maybe can argue on same lines for PAC code.0 -

8.3 If this Agreement is ended during the Minimum Period, you must pay the monthly subscription charges up to the end of the Minimum Period. This does not apply if you end the Agreement for the reasons in paragraph 8.4.
8.4 You may end this Agreement by giving us written notice if:
(a) we break this Agreement in any way and we do not correct the situation within 7 days of your request;
(b) we go into liquidation or a Receiver is appointed over our assets; or
(c) we increase Charges for your Inclusive Calls or your monthly line rental charge or change this Agreement to your significant disadvantage, provided you give us a minimum of 30 days written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel, or stop using, that Additional Service.
In the situations described in 8.4 above paragraph 8.3 will not apply.
Copied from the O2 T&C's. No mention of the handset in Section 8. It only says that if you cancel during the minimum term you need to pay up for the remaining months' line rental, but since it's a cancellation under section 8.4, you should not need to pay anything.
My personal opinion is this: You're paying *line* rental every month. When you signed the contract you 'bought' the phone, probably for nothing but the fact remains that you bought it and thus own it. I don't think you can be forced to return the phone as a condition of cancellation. After all, they broke the agreement, not you.0 -
I am on the original "100 mins anytime per month - inc cross network calls" o2 payg tariff. (min £10/mon top-up).
It seems that this option is no longer available, and has in fact been changed to 50 mins/anytime or 100 mins/off peak.
As per:- http://shop.o2.co.uk/shop/o2uk/jsp/tariffs/TariffSmallPrint.jsp
I have always used several 0844 numbers on a regular basis, and have never been charged (within my inc mins allowance). However, I am more confused than ever, as it now appears that inclusive mins cannot be used in this way.
I have quoted and highlighted the most worrying aspects below.
"Inclusive standard UK network voice calls are calls made in the UK to standard UK fixed lines (usually starting 01 or 02) and all UK mobile networks. These calls exclude video calls, calls starting 08, international calls, calls made to voicemail 901, calls made and received abroad, premium numbers, mobile internet access and information services."
Can anyone decypher this, and determine whether it applies to new customers only, or is this what is in store for all of us ?
i.e. NO 0774 or ANY 08** numbers0 -
For PAYG users, those terms apply to ALL customers. However, if you've not been charged so far then good for you0
-
Are calls made to retrieve voicemails on 901 chargeable then. Are these not included in the cross network minutes? There are three ways to get something done; do it yourself, hire someone or forbid your kids to do it.0
-
If you're on PAYG you will be charged. If you're on a contract, tariffs O2 100 and below will be charged, but O2 200 and above have free voicemail access.0

Hi Justme,
Welcome to Mse.
I have a payg sim with O2 as well. I have checked my remaining bolts allowance ( 100 xnet mins) and it came out that i had a full allowance.
Hence, it hasnt been reduced to 50 mins. It might be only for new sim.
Double check adn keep the forum inform.0
