    hi,

    i was wondering if anyone can give me some advise. I cancelled my contract on monday with the price changes after 6 months of an 18 months contract, i didnt cancel but i went to a Sim only package. after looking around i saw the HTC hero which i liked so went into the orange shop today to enquire but the sales assistant asked me a couple of questions about why i cancelled and said a bit curtly i cant upgrade you as your plan changes in september (when im due to start SIM only). after checking my online account today it did say i was due an upgrade and it let me upgrade to my £25 a month contract. what i want to know is will orange charge me for my sim only and now re-instated contract, (part of me is hoping the plan change will come into effect after i get my new phone but i dout it) sorry if this is very garbled but been a long long day at work.

    Hmm im confused?? Ive just checked my orange account online and it says im due for a upgrade in Novemeber .. I got a 18 month contract in Feb.

    I was thinking of ending this contract and got a pac sent out, plus a new contract but im not using the pac and im sending the new phone back

    Get your number ported and that will cancel your contract automatically. The -£186 should be a credit to buy out the remainder of the contract, meaning you'll owe them nothing.

    awww, just read this, poor Orange. Imagine being shafted like that...

    Lol, Orange shafted themselves, they only have themselves to blame. Shame they're still in business, I'd be out of my contract now, which I should have been if they hadn't denied me of my rights to cancel. Bar stewards.

    It was not fraud. It was just an automatic cash back deal. Look on-line they do the same thing there. However, I would have returned the phone within the cooling period and then went again for the automatic cash back :) (If the new t&c's allowed you to cancel within the 40 days without giving back the cash)

    Orange offer a 3 month upgrade before your contract runs out. Log on to your online Orange account and go to the Upgrade section - it will be available if your 3 months away from the end of your contract.

    Basically: The consumer was made aware of there right to cancel.
    The consumer choose to exercise that right.

    Carphone warehouse actually did Orange's job for them by informing the customers they had a right to cancel. So anyone from Carphone warehouse who choose not to cancel I can foresee them actually loosing there right to cancel if Ofcom tell Orange: "People had a right to cancel and you breached that: Now give those customers all there right back."

    Orange I heard from one there staff actually phoned up phones 4 u and carphone warehouse when they had there display showing 'Get out orange contract' and it was hinted Orange "had a word" with them.

    If your contract is due to run out within 3 months you can upgrade on-line.
    So are you currently saying you have upgraded to the £25/Month Contract? And a Sim only?

    If this is the case, you should send back the Sim only within the cooling period. The Internet Orange doesn't lie - the Orange staff sometimes don't know the 'truth' answer.

    If you have gone past the cooling period and your other contract is definitely going to end then you can't upgrade as the contract you had, is being cancelled and your starting 'technically' on a new fresh contract.

    But like I said send back the sim only, upgrade via on-line on your old one. Should be fine.
