    If you don't use the pac within 30 days - you loose the right to cancel your current contract. If you have a new contract and haven't acted on your PAC. Then your are position with two contracts out.

    Given you were sent the pac it meant your contract was coming to an end very soon and so they offer you the choice of upgrading online. Its just something they do within 3 months of a contract coming to an end.

    Did that make sense? :s

    Yes this is what this means from my understanding too.

    Again, if you dont act on your pac within 30 days your contract you wanted out of will continue to charge you and you technically 'didnt act' on your right to cancel. So do that as soon as.

    With the pac and not using it within 30 days - I do wonder if Orange are in the right with this one. As you 'acting' can just be a phone call and say 'I do not agree to my t&c's and wish to terminate', which in itself its acting. Having to use the pac within 30 days to me seems like acting twice.

    You should give them a reasonable time to respond. Which Id say 19 days. That's 5 days postage sending. 5 days posting back to you. And a week to act on it.

    That seems reasonable.

    9 days should be treated as a week as weekend does not count.

    Check if your on-line account still offers you the choice to upgrade. If it does you still can. Id advise upgrading on-line as opposed to phoning them, they might turn round and say we aren't changing the t&c now so don't have a right to upgrade.

    just tried to cancel and orange said they are not changing the t & c anymore cos too many people leaving. they said this changed on wed morning, is this true

    This is true. Did you ask to cancel your contract and denied before Wednesday? If so contact Ofcom complain you were denied your consumer right under the Communications Act 2003 at the time. They will give you a reference number which may come in handy for future.

    Just reading http://www.ofcom.org.uk/bulletins/eu_directives/

    If this is a dispute: Ofcom will reply in 4 months.
    A complaint: 6 months.

    Breaches of ex ante conditions: 4 months.

    Also I quote,
    "Consulting on the outcome of disputes
    19. Ofcom will only consult on the outcome of a dispute when the issue is of interest to a large number of stakeholders. In all other cases, consultation will be restricted to the parties involved in the dispute. "

    So if you haven't raised this with Ofcom you may not personally find out.
