Well he is being recorded anyway. You should have said there is a criteria to meet for there to be a breach. If:
- he hasnt complained in the last 3 months to you; and
- he hasnt gone over his minutes talking to you; and
- Say Ofcom agreed to the recording

i suppose you had to just be fast on this one, its been over a week you knew they would put a stop to it somehow. i took my orange contract out on the 8th july with free w995 and £200 cashback from mobiles.co.uk , cancelled it last week, so looks like ill be getting a new phone and cashback deal! What I find slightly troubling is some people claiming to being denied their consumer rights.....terminating your Contract because Orange has changed its terms
4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). However this option does not apply if:
4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period; or
4.3.2 the variations we have made have been imposed on us as a direct result of new legislation, statutory instrument, government regulation or licence; or
4.3.4 the variation relates solely to an Orange Additional Service, in which case you may cancel that Orange Additional Service in accordance with Condition 15.1.

I take point with the emboldened sentence.....you being denied over the phone does not constitute removal of your rights. If you wanted to cancel you just had to give 14 days notice in WRITING. So therefore if that was done before this U-Turn it would have been processed. They can refuse you over the phone as per T&C's.....
Some people fail to notice that point however.......
IF YOU ARE AWARE OF THE COMMUNICATIONS ACT 2003, you dont have to give written notice, You can verbally not agree to the new terms to which they have to acknowledge, which they havent done in many cases. and hence why now they are b eing investigated by CISAS after my partner logged formal complaint. Once you give them a deadlock ref num they will investigate orange0
