Its undertsnadable that you want to protect your child no mater what as any parent would including myself.

I really would advise seeking proper professional advice on the matter as every situation is different.

I really do hope that things go your way and you get the outcome you are wanting, but even if the judge grants the prohibitive steps order meaning that the half brother isnt to be left alone with her, who will be policing that order - (im assuming it will be your ex), the one you said isnt really bothered. This would worry me more as it still leaves you in the same situation. Your child is still not protected.
Is there already a contacts order in place for you to break it, or is this something you expect will happen in the future?

If there isnt one in place then i wouldnt be worrying about breaking it as it hasnt happened.

Have you spoken to your ex about your DD's allegations? Would she be able to repeat them in front of him?

I can't believe he would want to put her in any danger, however c**p a dad he might be.

Give the system a chance to find in your favour before you start worrying unneccessarily.....

You have enough on your plate without wondering about the 'what ifs'

She's only 7, is very likely to be believed. Good Luck, hope it all works out fine.

Have you PERSONALLY contacted the Director of Social Services at your local Social Services Department at your local Council and arranged for a meeting with a Child Protection Officer. If you don't get any satisfaction on this issue and reassurance that your daughter will be protected, I would contact both the police and enlist the help of your MP (Yes, I know many of them have been involved in an expenses scandal but often in an MP takes up a case personally with various agencies, they will often take the issue more seriously. There's an election coming up in 12 months time so may him/her work for your vote.

Sorry I didn't reply earlier, I have been a bit shell shocked and very, very angry...

It didn't go well at all, both my mum and I were basically shouted down by the barrister. She said that not trusing my ex not to break any Prohibited Steps Order was not a "complelling" enough reason for contact NOT to be ordered in Scotland, she said I would have to make a "leap of faith" some day......and she basically said that she would advise me to let him have contact in Scotland provided the half brother wasn't there....

So I basically got steam rollered into agreeing for him to have contact in Scotland after a few overnight visits here (three in total), she said if I broke this order I could end up in prison.....

So just really really angry and basically like whats the point? No one listened, he got what he wanted without showing ANY acknowledgement of even the possibility of the incident taking place, despite the fact the judge said he would have to. Sent my Ex a text today sayng do you acknowledge the incident took place yes or no - so far no reply.

Now he is contesting my DD's name change, he wants her to keep his name despite the fact she wants to be called by my name and is in fact known by my name at the school, doctors etc....

It was a bitter bitter pill to swallow when the judge congratulated us for agreeing the contact, basically I wasn't given a choice, the barister said my reasons were simply not strong enough. The long and short of it is I could eventually get sent to prison for trying to protect my DD. Whilst my Ex swans around acting the big "i am" because he's won....its so so not fair. He has contributed nothing to her upkeep, nothing......he has'nt even tried to and he only ever visits two-three times a year.

Further to this my DD said that he had hit the half brother with a belt WHILST SHE WATCHED...and STILL its OK for her to go up there....

I have just finished a law degree but I won't be having anything to do with the law, I have no faith in the system whatsoever.....

Sorry I just want to cry...

Did you not have anyone representing you against this barrister.

You now have to answer your own question -

Wuold you break the law to protect your child?

My opinion is still exactly the same.

Please dont give up your career with the law. You now have the biggest motivation you can have. You
have the opportunity to help people like yourself. Go get 'em and good luck
