You cannot get more out of a company than there is in it (cash and saleable assets); companies tend to go out of business (or bust) only after a period of poor trading and hence they owe more than they have, someone will lose out and it tends to be the supplier (or in this case customer too).
The problem is that these companies are playing the odds game and know that a certain percentage of people will forget to claim (maybe raised by making the rules harder to comply with or not playing with them themselves).
Then the public finds out that the cashback is not as easy to get as indicated, that there are questions over the integrity of the company and they stay away, sales drop and the company struggles and goes out of business.
My advice then is get in there fast to try to get your money out of them before someone else does and you end up with nothing (once they go into administration/liquidation).
To sue the company would be fruitless, it has nothing to pay with, you can't sue the directors unless there is a possibility of some fraud and you can prove it (hard to obtain cashback is not the same thing).
Hence stick with the big companies that play the odds right and fair and are more likely (not definitely) going to be around to pay out.Toyota - 'Always a better way', avoid buying Toyota.0 -

My point is more that if you wait and do nothing, when a company goes bust
you will be very lucky to get anything.
Not knowing the details, but if you'd have gone to Farepack (sp) before it went bust and took your money out you would have probably done better than those getting 4p in the pound now.
That said, if everyone had gone for their money it would probably have gone under quicker.

I have just filed my claim with moneyclaim, will let you know how I get on. If it works my husband will do the same.
I have written to Watchdog too, if enough people do then I'm sure they will look into it eventually?

I have just rang the Mobs to look for my cashback which was due in August.
After nearly three minutes on hold it then just rings finishing in a recorded message stating that there is no reply and cut me off.
I will write to them as well but I am not hopeful!0 -
I haven't tried. I've always copied him in on my emails though. I wonder how about an impact in numbers campaign - ie all of us write to him on a certain date recorded delivery. I also thought we could have a mobs night, where we ring the sales line all evening keep them talking for ages then demand our cashback! At least while chatting to us they won't be able to sell any more phones to unsuspecting customers! ( you can tell I spend hours thinking about this can't you!) Anyone interested?
