In regard to the dates, I am not sure if I can use this excuse to get out.
I purchased the phone on the 29th of March 2009, one of the letters that came with the phone has this date.
Another letter, the actual receipt is dated 31st March 2009.
My welcome letter is dated 1st April 2009.
The bill period on my first bill is 1st April 2009 and bill date is 2nd April 2009.
I will be trying to cancel tomorrow using the same excuse, but until then, based on the dates, am I eligible?

Don't know whats funnier, the fact problems stem from 2003 on the account & now 3DOM through 3's own stupidity and complete SUCCESS to ruin a brand by saving money to India which has cost 3 alot of sales/revenue as India done more damage to brand that management have ever done to 3's finance books or the fact the nice young man couldn't grasp a proper English sentence as a " 2003 founding customer " was slamming the door........." and we very are sorry so to be having you leaving TREE " :rotfl: :rotfl: :rotfl:

billing has nothing to do with your start date, receipt is the key

Yeah it seems like it. The 29th was the date I purchased the contract and so is the date where I 'read' the terms and conditions and agreed to them.0 -

but due to " order processing " then " receipt " is your official date, not your billing on 1/4/09
ie.... you buy a radio at tesco, one year or 12 months ( whichever is applicable to retailer, same same really in a court of law ) to the date under UK law you take it back as faulty to Tesco then your covered, one day more & you have no retailer warranty, but under sale goods act you have a claim with manufacturer if it was reasonable to expect the radio to last longer, generally that can be up to 6 years use for electrical items
a receipt under UK law is more than a proof of purchase for 1 year/12 months warranty, its a legal binding DATED contract with retailers/services/manufacturers regardless of any future BILLING PATTERN for such where billing applies
the pre April terms apply to you as a consumer with the T&C you agreed to on 29/3 came into force on 31/3 with that dated receipt, 3 really could have delayed your order to show receipt of 1/4/09 and gave them protection not you, but the company that is a DEALER & runs 3store on three.co.uk WILL not have been informed by 3UK....a massive oversight 3 - the OFFICIAL 3store dealer gets commission & you get to leave, its good to be 3

3WEBSALES=DEALER=3RD PARTY NON 3 COMPANY, if you have problem with websales 3 have no access to the DEALERS computer system & any investigation is fundamentally flawed, I know someone who returned in a bag sent out to them via websales & spent 18 months paying a contract they returned ! Customer services at the end of contract admitted websales is nothing to do with 3 its a 3rd party company when customer was asked " why are you leaving "

i don't think grassing people up will help anything, whether they disguised as an investigation or not. To be honest mate, it sounds as though you (and others who've not succeeded) have never used the service, and while a part of me did just want out of Three, I have used the service in the past and have holiday plans booked that will be affected by the change. I sympathise with your desire to leave your contract, but you're not being directly affected are you?
You're using it as a method to escape a binding contract, which then leaves it down to discretion as to whether you are being affected or not. That's how these always go, see previous threads about changes to 0800 numbers as an example - people who didn't use them didn't have much success.
its contract law, surely that cant be at their discretion ??
Ive never used the service but i am planning a big 6 month trip this year, im going to be just as effected as someone that had one holiday last year
