Sale Of the Goods act regulates your relations with the retailer, not the manufacturer. I believe it says nothing about warranties in general and manufacturers' warranties in particular.
You're correct the Sale of Goods act makes no references to the issue, however I didn't make any reference to the Sales of Goods Act - Section 3 in the below:
"There is no obligation on retailers or manufacturers to offer guarantees. However, where guarantees are offered at no extra charge to the consumer, the [FONT=Arial,Arial][FONT=Arial,Arial]Sale and Supply of Goods to Consumers Regulations 2002 [/FONT][/FONT]provide that they will be legally binding "

At least what my opponent actually claimed was that warranties were not legal contracts between a consumer and a manufacturer.

cgk1 has given you a personal opinion, I've given you a personal opinion.
However mine is backed up by legislation [FONT=Arial, Chicago]that came 23 years after the Sales of Goods that is referenced in the other thread along with a trading standards link that explicitly states you have a right of redress if a manufacturer won't honour its published warranty promises.

Was just about to enter payment details at bmp.net, then thought i'd check here.... needless to say I was a tad concerned.
But, the deal I was thinking of doesn't involve redemption or 'free' gifts, its just a free phone and decent monthly tarrif.
Am I right in thinking I am still safe in going ahead with this contract? If they were to go bust, i'd still have the phone and the contract (calls + texts) would still be in place with O2?
svgt3 I did the same, had a look on here and was sceptical about them, but I was interested in the same deal as the one you are talking about. As there was no cash back and no free gift I decided to give them a try.
I applied online and got an e-mail the next day to say there was unusually high volume of orders and mine would be dealt with as soon as possible so I thought oh no here we go, this was Monday. Anyway I got accepted and the phone arrived Wednesday. Charged it up, put in Sim Card and phone wasn't working, by this stage after everything I had read I was starting to sweat a little. I contacted them by phone on Thursday and they could not have been more helpful, I posted the phone back Thursday Guarenteed Next Day Delivery and had my replacement by Saturday.
I have to state I cannot fault them at all, they were brilliant and I feel a little sorry that people seem to think they are a scam, to be fair though like I said I did not go for a cashback or free gift option, but I would certainly recommend them to my friends.
That said I'm not so impressed with my HTC Sensation, lots of glitches, read up on the Android forums before you make up your mind if thats the phone you are after. It's a beauty of a phone, but there are a lot of niggles need ironed out, that said it is growing on me!0 -

Placed an order with BMP last night, getting a JCB Tradesman on T Mobile with 300 texts 300 minutes and 500 MB data for £0 if all redemptions are met plus I went via Quidco and will hopefully get £30 cashback. I am willing to take the chance that the company are still trading in 18 months time. I am very organised and will do all that is asked of me to claim my cashback.
Hubby is currently on an 18 month contract (with a different company) and so far all claims have been put in at the correct time and all cashback has been paid.
I am happy with my current phone and not chasing the dream and constantly wanting the newest versions which are released so if all goes well this will do me just fine.0 -
I have bought two mobiles via BMP and one via E2save and have ported the old numbers once the phones were recieved.
E2save is quite clear in their cashback requirements that they must be notified of the new number and the facility for this is easily followed on their website.
I cannot find any requirement in the BMP conditions to notify them. Could someone in the know please advise if I do need to notify them in order to claim cashback. Thank you.0 -
I think any cashback company has to be notified with some proof of porting like the bill showing both the original and ported numbers. Otherwise they have no means to link the bills you send them to the contract they sold you.0
