  • does anyone have a copy of the older T&C's that where on there web site which are relivant to my contract, i took mine out in feb 2006. Im waiting on 2 cashbcaks for 2 contracts one is about 50days from them recieving and the other is about 40 days, ive sent a 7 day before court action via email and made 2 phone calls and had the 10 day promise still no payment made to me.

    I am new to this forum, the main reason for joining up to this forum was to let you all know what I did to Mobile Rainbow when they avoided paying the cashback due to me.

    On my T and C (I took out my deal in Feb 06), it stated that cashback claims would be paid within 30 days of them receiving the claim.

    After waiting for the full 30 days, I contacted them only to be told the usual response which alot of people on this forum have also received. Your cashback will be received within 10 days. I gave them 14 days instead of 10 and then I made a claim via https://www.moneyclaim.gov.uk.

    On my claim, I stated that as this was my second cash back claim and Mobile Rainbow had breached their own Terms and Conditions, I wanted them to nulify the deal eg. Pay all cashbacks that were due to me for the entire deal as I had no faith in the company in paying any future cashback claims by me.

    So I issued a claim which totalled the amount for the Second Cashback and also the third cashback (Which was not due yet) + the costs of the claim which was £30.

    This money arrived in my account within 3 days of them receiving the Court claim letters. So much for it taking 10 days as previously stated by them to get the money into your account!.

    I urge everyone who has cashback that is due but still has not been paid by Mobile Rainbow to do the same. When issuing a claim via moneyclaim against Mobile rainbow, make sure it is not for just the cashback claim that is overdue but for all the outstanding cashbacks due as part of your deal.

  • I have also started the online (https://www.moneyclaim.gov.uk) claims procedure as mentioned earlier against Mobile Rainbow. However the charge for this service was £50. Has it gone up??:confused:
  • Having problems getting my 2nd cashback from mobile rainbow for the past 6 weeks now, same thing as others here, IE money in 7 days, 10 days etc, basically i've been reading that before I start legal proceedings I should send them a letter telling them of my intentions, has anybody had experience of doing this?? And if so would any of you be kind enough to PM a copy of what you wrote, any kind of help would be greatly appreciated.

    the court fee is based upon the amount you are claiming from the defendant, so it varies

    dont bother giving them "notice to serve action".....waste of your time...i dont think it is a requirement in any case.

    so long as you have made all reasonable efforts to get the money up to now there isnt any need to warn them...
  • I agree with the above post. All I did was contact them after the 30 Days were up and they told me that it would reach my Bank account within 10 Days. I waited 14 days.

    Once that time period was up I went straight onto MoneyClaim online to start my Claims Procedure. I did not bother write to them to give them further time or threaten to take them to the Small Claims Court.
  • another thing, I have two phones from them, does this mean I should submit 2seperate claims to the court or both together??
