Yes I've had about 3 phone call to check my bank details, and then had a call last thursday to say I would have my money in 3 days. A week later I've had nothing. I'm going to send the same legal threat as you metalgearal.0

Dont bother giving them a "notice to sever court action". This will only waste your time and there is a risk that the company will cease trading prior to you starting court action.
I commenced court action against MR and within days I received a cheque from them for my cashback plus the court fees.
They have since submitted a defence to my claim. However the funds have already cleared into my account.

oooh! I should have checked the company (Mobile Rainbow, MSOLS) before I got the contract!!!
I think, after all you wrote here it's better to cancel the contract (at cost of £19.9, but peace of mind is worth it...). I know that I should return the handset in the original package by special delivery to the address indicated within 14 days from activation (which was on Friday 17th). Is there anything else I need to know??? What would you advise to do?
Shall I call 3 right away to tell them I am cancelling the contract or MSOLS will do it automatically (which is unlikely, I suppose)...
please, give me some advice as I need to act asap, otherwise my 14 day-period will pass.

after more than 50 days and many promisses to deposite te money in my bank account and cheque in the post i gave up to their promisses.
As a member of Which? i contacted Which? legal department and asked for help.
the instruct me to send them a letter and give them 2 weeks ot deposite the money in my bank account otherwise i will go to County Court.
I trust Which? to help me the same as they help many other in other cases to recover my money.
I will be more than happy to update you all.
Is anyone in this forum is a solicitor and may would like to represent those waiting ofr cashback in a big case in a court - we will have much more power as a group rather than individual.
if you are just in the beggining of the contract and still can change your mind, don't think twice - cancel the contract as there is more chance you won't get your money back.
making phone calls to their call centre is a waisting of time.
for the next cashback - and the last one - in a month i am going to wait 30 days for the cashback and than go to court. no more calls to their call centre as it is only delay the payment and at the end of the day that all what they want.
I won't be surprise if they will disappear very soon.

I am not a lawyer but I do have two (well, maybe three) things to say about the above...
(1) Which is going over the top for this situation - Small claims court is all you need - you can submit a claim at https://www.moneyclaim.gov.uk (a government run site) for £30 and add the cost of submission to your claim. You don't need legal representation for Small claims and this route of redress has been well documented and shown to be consistently successful where errant cashback retailers are concerned.
(2) For subsequent claims it is still worthwhile sending the retailer a "letter before action" giving them 14 days to comply once their stated payback timescale has passed (prior to actually taking out a claim) - this can be referred to in your small claims submission to demonstrate that you reasonably gave the retailer the option to resolve the matter out of court.
(3) (2) above may prove to be irrelevant if you simply file a submission this time around for the FULL cashback amount (stating that you intend to do as much in your "letter before action"). As the retailer is now in default there's no reason why you should still have to jump through their stated hoops to get at your cashback in full. There is anecdotal evidence that at least one retailer (I think it might have been Mobile Rainbow) has been presented with such a claim and paid the entire cashback to prevent it going to court.
For me, the jury is still well and truly out wrt to this retailer - I *still* don't have the confidence to include their deals on my site. It's now around 18 months since they first launched on the internet and, to my mind at least, there is still no consistent evidence of an intention to payout on their cashback promises.

Update!!!
Just to let you all know that I have received my 1st cashback (even though in e-mail correspondence from MSOLS it says 2nd!) into my bank account yesterday. There is hope.........!! Not long and I'll have to send in my 2nd claim, so fingers crossed!!!!!!! MERRY CHRISTMAS!!0 -
I have filed for a full cashback claim through the online claims procedure on 21 Dec 06, after waiting for over 2 months for the first cashback payment . However to my amazement a cheque arrived through the post this morning for the first cashback. Now I am unsure as what to do, do I let the claim procedure take it's course or let the claims court know. I do not want to go through this ballache for the second and third cashbacks again.
Also I have noticed they have changed the T&Cs on their website, so you have to go through more of their obstacles, does this mean I have to abide by these or the ones that were current back in May 05.
