    For me, just further clarification that cancelling that order a few months back was a great move!

    Did you have to pay a court fee Millwall? If you did was it included in the claim amount?

    It looks as though I'm in a similar position. I submitted my September bill at the beginning of October for the first of three £70 cashbacks. Six weeks later - nothing. Rang them on 0870 and they said I should have sent the October bill. I said that the sheet of redemtion vouchers showed a table with month of purchase (April) and bills to send. They said I was CONNECTED in May and should have sent the October bill and now I was out of time. I said the table showed month of PURCHASE. Then they said that they had changed their policy and I should have sent all of my first six bills.
    I disputed this and they asked me to fax/e-mail a copy of the sheet (which luckily I had scanned) and then call them next day (Saturday). They said they couldn't access the e-mails and that I would receive an e-mail reply on Monday. This didn't come and I was given the same reply on Wednesday when I rang back. I still haven't received the reply.

    Do I have to go to the small claims court or the Office of Fair Trading. What do I do to get them to pay up?
    Are O2 or Motorola interested in this sort of thing?
  • hi jay b, sorry to hear about your predicament....such confusions tend to arise when the phone is purchased at the tail-end of the month, and the network officially starts billing you on the next.

    i think there's a govt-run website which kinda simplifies the whole small claims procedure....think its called moneyclaim.gov or something like that (someone who knows more might wanna enlighten us); going thru them includes a £30 fee which is re-claimable if you r a successful claimant.

    unfortunately, O2 or Motorola probably won't be too interested in your situation, motorola moreso than o2

    Thanks, skip2mylou. Yes I've found moneyclaim.gov.uk and it looks as if I may have to use it. I'm on the phone to MR now and I'm still hearing the same rubbish. What is the matter with these people?

    PS. they've called me back and said they will honour the payment which will go into my bank account in 15 days. I'll wait and see.
  • good, glad you found it....in my case, MR paid up after I threatened legal action, I didn't have to physically file a claim....the 2nd cashback was a bit smoother, money still came late but everything was settled over the phone

    (P.S. use the 0800 number forget the 0870 one)

    Well today is day 10.........and i have not received my cashback......so to recap the timeframe...

    9/10/06 claim sent by special delivery
    10/10/06 email sent asking for anticipated timescale
    10/10/06 letter delivered
    12/10/06 email recieved saying i would receive my cashback by 10/11/06
    10/11/06 no cashback received, sent email chasing it
    14/11/06 no reply to the email, so I phoned them up and they said that the transaction was progressing and i would receive it within 10 days
    27/11/06 i sent a reminder email asking them to confirm that I would recieve the cashback prior to the end of 28/11
    28/11/06 no cashback has been received. I do receive an email from them advising me i will get it within 10 days.....HOWEVER the email is a copy and paste of a previous reply and inspires me with no confidence !

    Doesnt sound like i will get my cashback does it !!??

  • lfc84....i think and sure hope you will get your money...stay positive, my cashbacks were, so far, on avg late by 11 days
  • well sent my 9th month claim in 29/10/06 and they recieved it on the 30/10/06 so the 30 days is up will email them later and see if they respond, will give them a few days to respond then issue the 14 day warning or court action via email and recorded delivery post and then just issue a claim for all my cashback due to them breaking there T & C's.
