    Hi all

Just looking for a bit of help from peeps in the same boat..

My folks ordered a kitchen from MFI at the end of October for a total of £6618, £2000 deposit paid on Marks & Spencer &More card, balance on a Nationwide Visa Debit.

Nothing was delivered and following the advice placed on the MFI website by the administrators my dad sent a letter to M&S under s75 claiming back the full amount.

M&S have said they are very busy with claims from MFI customers and have agreed in principal to refund the £2000 but no word on the balance (paid for by Nationwide Visa Debit card) as yet.

Should he pursue a claim on the chargeback scheme with Nationwide for the balance of £4618? I'm mindful that you only have 120 days to claim, and with M&S not committing themselves either way I don't want to risk them being out of pocket.

    UPDATE

M&S are refunding the £2000 but have declined to pursue the balance of £4618 as they say Nationwide are able to pursue this. Apparantly if the other card's bank have the ability to chase the money, M&S don't have to.
    Can this be right?

I was under the impression that as long as the deposit was paid for on the Credit Card it was immaterial how the balance was paid?
  • I had ordered a kitchen from MFI which I paid a deposit on in November 08. MFI got my deposit but I did not get my kitchen. I paid the deposit on my Barclay debit card. I took advice re section 75 and went to my local Barclays branch who rang barclaycard up for me. I received a customer dispute disclaimer which I completed and sent with as much info as possible, bank statement transactions, invoices and emails. I have now been refunded my money so I hope this helps someone. Under section 75 I believe you have 120 days to ake your claim within if you are wanting a refund.

  • Update on my situation. As mentioned above I paid £750 on my Barclays debit card as a deposit but told Tesco, who I paid the balance with that I was claiming the full amount from them. Barclays credited my account for £750 late yesterday. I will now contact Tesco credit card and tell them I have got my deposit back and I won't be trying to collect it from them.
I have now got all my money back and the whole sorry buisness can be put to bed.
Furthermore, I really do have to praise Barclays debit card services and Tesco clubcard creditcard, both companies have been fantastic at what has been a very worrying time. Barclays didn't even get my forms back until 22nd Dec so well done both of them great work all round.
Hope you all end up as happy with the outcome as I am.
Just one other thing...Up until the MFI saga I'd never used this website. It has proved to be a valuable source of information throughout, not only that but this thread on this forum in particular have been superb.
Thanks all, and good luck with getting your money back!:T

  • Can anyone give me some advice..... please??
I purchased a fully fitted kitchen, appliances etc, Dec 07, for £15800.00. Paid part credit card, part visa debit card and part cheque. The kitchen arrived and fit commeneced 01/04/08. We had loads of problems with the fit, damaged units, fitted incorrectly, wine cooler cannot be switched on, wrong dishwasher received, damaged granite work surfaces etc and felt we needed to go through The Furniture Ombudsman to get a resolution (MFI are registered for these sorts of problems). This process took until 25/11/08 when we were finally given our award. The only problem is that MFI went into administration on 29/11/08. So we were told no further action would be taken and we would not get our award of compensation (that we need to get things put right).
It seems our case is very grey in areas and whatever we try we cannot pursue.
    Any help would be grateful.
    Thanks

When the 12th of Decmber, the promised delivery date of our MFI bedroom furniture, came and went, we nervously waited and watched this forum and the MFI administrators website for news of developments. Phone calls to the MFI helpdesk went straight to an answering machine, and an e-mail sent to them only got an automated copy of the website information. It came to our notice that suppliers to MFI had removed all the fork lift trucks from MFI’s warehouse near Doncaster, so it was fairly obvious we weren’t going to get our delivery any time soon.

Folowing advice from the administrators website, and using Martin’s claim letter as a template, we wrote directly to the card issuer, Alliance and Leicester, for a refund of the £1600 that we had paid by credit card back in November.

After a long, worry inducing wait, I’m glad to say that today we received a letter from A & L to let us know that a full refund had been credited to our account without any quibble or fuss. (A quick check on-line to make sure the money had gone in)

We’ve banked with Alliance and Leicester ever since they bought up the National Giro in 1990 and have always had good service from them. This experience just adds to our confidence, I just hope that now they’ve been bought up by Sentander the service remains as good.

We hope the experience of anybody else who has been MFI’d is as successful.
