Also if the phone was faulty why didnt he return it
Hes trying it on mashy
Let the court sort it out.

Whether he claims its faulty or not is mostly irrelevant, because he has an item he has not paid for full stop. I think you'll be absoultely fine. I wouldn't accept a return on the phone now anyway, he could have damaged it or anything.0

this guy is a joker, now he has called me and left me a message in the most polite manner, what happened to all the swear words that he was using on msn!. Maybe he's recording his voice to say he contacted me to say the phone was faulty, here's what he said word by word,
"yes this is a message in regards to the d600 phone from ebay I am calling to inform you that the handset is infact faulty, there are numerous things problematic with the phone one being when you go to messages it says that there are different recipients have sent the messages which is incorrect, at the moment I am in the proccess of actually contacting paypal in regards to what I should do, you informed me that its telling you you're over drawn yet mine is overdrawn so therefore this needs to be sorted out now and by you not answering your phone your just making things worse so therfore I have made an attempt to contact, this will be taken further, if this does end up in court I look forward to seeing ya, if not, you need to contact me don't ya?ok?"0 -
Good grief, well you've certainly given him a fright lol!
Don't fret, sounds to me like you have more than enough to be going on with to back yourself up, I still wouldn't reply, I'd just let the claim begin and leave it at that.
All he has to do is say ok I'll pay now, and its sorted - yet he is persisting in messing about.
Just ignore all this, and keep everything!
Just a thought, dont know if you have read these but here are ms_london's posts about her own experiences of the small claims with ebay: this one and this one.
I've just had a flick through and can't see if anyone has popped these in - if they have, apologies - I've got one eye on the clouds for snow!0 -

have you barred the phone yet??????0
-
no im not going to yet, i will do after the courts decision, if I barr it now he will bring it up in court and then he can say it was barred when I bought it0

Mashy
He wont beable to as the service provider can supply the date when you complained about the phone and it was switched off.
JaffaR.I.P Sam, still in my heart0 -
yes but then it would be a hassle to ask for all those details, why not wait till the judgement has been made?just to stop him from using the phone?that won't benefit me at all.0
