Hello.....
Thanks for the person that provided the link to the small claims court online, I made a claim, and the defendent (ebay scammer) has admitted that all of the money is owed £160.50 + £30.00 court fee (which I had to pay upfront), this is fab, I totally expected the person not to reply or anything, so I have said that I want the money in full & IMMEDIATELY, so lets see what happens.
The thing is, if they pay by cheque, how much do you want to bet that the cheque will bounce? Still, if this happens I am sure the Courts will have something to say about this....
Meanwhile, I have heard NOTHING from ebay and am totally unimpressed with their Customer Service. I also reported this to the police, probably the least of their worries, but still.
To everyone that has been ripped off on ebay, dont let them get away with it like I was going to. Report it to the police & file a claim.
I shall let you know what happens.

Thats great - i have to say, I was dying to know what happened with your claim. I have threatened this before but the threat has always been enough so far.
Just out of interest, what was the actual process after you filed online - did the court write to the person and this got a result or did it get further than just written correspondence?

I am so pleased to hear a good resolution to this. As for the cheque, I'm unsure - sorry I can't be of any help to you, particularly when you were so helpful to me.

I had to pay £30 at the time of filing the claim online, then the court sent a copy of my claim to me & also to the person, they have 14 days to respond (starting 5 days after the claim was sent, to allow for postal delays), and it goes from there. It makes it easier that he has admitted that he is guilty (so to speak), otherwise its a longer process, and goes on admission by default (i.e. not responding to the claim). I am suprised he didnt ignore it. I could have given him a chance to pay the money back installments, but I dont think so, why should I help him out!! :0)
Look forward to getting my money back FINALLY!!!!! Shall keep you posted, thanks for all your help.

People really should use the small claims court more in this type of situation - it's what it was established for, and with the ability to file a claim online now it is even easier.
Remember, however, that sueing someone only works if they have the funds to repay you.
If the scammer sends you a rubber cheque, you can go back to the court but the court will charge you more fees (which you can add to the amount the scammer already owes you), but if the scammer has no money, it will be you that is left further out of pocket."Now to trolling as a concept. ....
