Help!Buyer constantly delaying payment

I have had 10 missed calls from him, and he has left this message on the dispute:

i am unwilling to make payment as the phone is faulty, i no longer wish to trade on ebay as the
exprience with this person has made me no longer wishing to trade, i have tried to make numerous phone
calls but he will not answer, if he offers to get the phone repaired i will make payment! the reason
the payment was reversed, not by myself but by paypal is because the bank account was closed, simple
as, it was my bank account and i am well within my rights to do that0 -

As you can see the buyer has contradicted his first statement that he had made the payment claiming
that he has paid. Now he is saying "he will make the payment if I repair the phone". The phone was
brand new as I have indicated and it is not my responsibility to repair it when the buyer has used
it for almost a month.0 -
if I close the dispute, will I get my final value fees back?
I think I will leave the dispute open for a day or two so I can show him that I have a good case against him without having to talk to him directly. Will ebay read all of this and judge or do they simply not care?0 -

i just tried to call you 3 or 4 times, but no answer as always, oh and be advised, its against the
law to record conversations without the consent of knowledge of the party who you are recording0 -

I don't know if it's illegal (google for it!) but it's certainly inadvisable and I don't suppose you would be able to use the recordings in court. After all, that is why you always get a "your call may be recorded" message from call centres, and why recording devices should put a peep on the line every few seconds.
I also think it is inadvisable to try to break off communications with this guy - I imagine he could use that against you, too. But, to avoid being hassled, I would define a method of communication such as eBay messages and stick to that. eBay messages are, after all, much easier to verify than instant messages, emails or text messages.Time is an illusion - lunch time doubly so.0 -
Just stick firm and do not panic. After all, "i did
make payment but paypal reversed it as i closed my account down!" implicates him fair and square, because:
1) I don't see how closing your account, once a payment has been made, would reverse it, because payment has already been made (so he is lying);
2) and even if it did, it would still be his responsibility to get the payment to you - in a timely manner - which he has singularly failed to do.Time is an illusion - lunch time doubly so.0 -

would have been made, but now i am with a phone, that whenever you go into your messages, it says
that the message is off someone else, and it freezes, very bad in my opinion, so i cannot even sell
the phone on, as i will have the same problems i am having now0
