    ALL YOU SHOULD TELL HIM is the fact that you have instigated legal action against him in the small claims court (you have, haven't you?) and that he has the option of sending you the total cost of the phone PLUS THE £30 FILING FEE before the deadline set by the court, which he will be informed of when they contact him. If he doesn't do this then he will have to appear in court (or have a judgment made against him by default).

    Be firm and he will see that you are not bluffing. If he still thinks you are, when the court letter arrives he'll get a nasty surprise.

    PS Someone's clock is running rather fast!

    PPS Whether you are Pakistani or not, calling you "Paki" was racism. Don't bother opening that particular can of worms though!

  • its all done, to be honest I think this buyer is not going to pay and is going to come to court, if this does happen, will I need to find a lawyer, how much would that be etc etc

  • I take it the removal of feedback on ebay does not mean this is all done and dusted? Apologies if this has all been sorted in the dead of night and my post is pointless!

    I think all the contact you should make now is quote Gromits post (or something akin to it) if you reply to anything else, and leave it at that. Don't let the situation get more rowdy. I don't think you should say anything else in the dispute at all

    The small claims court is different to ordiary court. Its all done in letter form in the hope of the case not reaching court. You won't need a solicitor.

    Here's some help about the small claims court (click link in blue), read this through carefully. Its a great system for people like you who are in a pickle. You only end up in court if the case is disputed, chances are he will pay up as soon as he gets the stuff because he is clearly in the wrong, and it would be hard to wiggle out of it.

    Just wait it out now. I know its stressful and it was a lot of cash, but I think by only replying with that info above, you will make your point better than any long winded slanging matches between yourself and the buyer.

  • thanks puginbed, I have done and closed the dispute, I can copy paste the whole dispute here if anyone wants to read it. just one question, assuming the buyer pays via paypal, can I immdiately close my paypal account so he can't reverse it again?what's the best and most method of payment so that I know the money can't be touched(excluding cash in hand ofcourse)?
