Help!Buyer constantly delaying payment

If Paypal try to remove funds from you but youve closed down your paypal account and cancelled any credit cards that are linked to it. Paypal will create a debt for you. They will refer the debt to their debt collection agency. You'll probably end up with a unfriendly letter in the post demanding the debt be settled.
This happened to a friend of mine who sold an item, got paid via paypal, and as you do - posted the item, and AFTER all that paypal realised the buyer was actually a fraudster. So through no fault of the sellers, they then want to penalise the seller by removing his funds.
He consulted sites such as paypalwarning.com or paypalsucks.com and found a standard template (letter) that he sent back to the debt collection basically throwing the ball back in their court highlighting a few facts such as one where paypals security is to blame because it allows payments to be made to you but then takes them back at its will which is effectively stealing.
A good way to recieve money is the good ol cheque. Takes longer, but at least you know the money isnt going to be swiped from your bank account after its cleared.0 -
the guy called me today left a voice mail saying "he has recieved the claim form and said that he made the payment on the 29th when I closed the dispute and his paypal account says this, he said he will contact paypal and also make a counter-claim against myself and will appear in court",
I texted back that I still have recieved no payment on paypal and that the claim was created on the 28th.
then he phoned back leaving a message saying "he will send me screen shots of his paypal account and that he thinks this has gone too far and did not need to come to this",
so I thought I'll give him a chance and went online on msn and texted him to let him know
but he called back again leaving a message saying "I have to catch a train at 9 to see my ill mother and don't have the time, please answer your phone, I am only going to tell you what I am going to do,I even give you permission to record,I will also send you a screen shot of my paypal account and my train ticket to proove that I haven't been lieing this time, and I have not lied previously"
but I didn't answer and didn't text him back.
What happens if he makes a claim against me saying that I have recorded phone calls, however infact I have not recorded anything(only texts and one msn conversation) and was lieing, is it illegal to make a recording for myself and if I do not use it in court?0 -
Gd morning ashy
I would just let the court do its thing and ignore the buyer .
His mother maybe be ill but its no excuse not to pay you after this length of time.
As for paypal if it aint in your account he aint paid simple as that.

thanks jaffa, I think the buyer is regreting not paying now since now he has to pay extra, I guess he should learn his lesson.
Can anyone answer the question I have quoted. The only way I have thought of to get around it is to say by phone calls I meant the voice mail messages he has left me since I do not need permission to record that.0 -
hah!he called again but I couldn't understand all he could say in the message, something like he contacted paypal, couldn't get through to them or something, he said "at the end of the day (his favourite phrase) I have a phone bill saying how many times I have called you and you have not answered and I will bring it to court with me, I advise you to call me"!. He just wants to talk to me to see how confident I am to ask me questions on the spot that I'll have trouble answering, I have taken your advice and will not call him.0

I think it is a very long process if he does not admit he owes me money. He claimed that he has filed a counterclaim which means I owe him money! so god knows how long it is going to take.I think it could take months0

Good luck ashy_mashy! What a horrible story. eBay and PayPal suck!0

Zackeriney wrote:have you blocked the phone? i think that you can block a phone then if he pays you cango into the shop of the service provider with your id and they can unblock it again as it was yours in the 1st place and was you who blocked it. i would double check but if you can do that block it and then if he pays unblock it later
i have been saying this for ages. just block the thing. i wouldnt give him the satisfaction of using it.0 -
Yup - I'd've blocked it days ago.
JulesThe ability of skinny old ladies to carry huge loads is phenomenal. An ant can carry one hundred times its own weight, but there is no known limit to the lifting power of the average tiny eighty-year-old Spanish peasant grandmother.0 -
yes I will have to check whether I can block and unblock it, I have already explained why I don't want to block it,however I will do if he decides to file a counterclaim. Can anyone answer the questions I asked before about him claiming that I stated that I have recorded his phone calls without permission?
Another problem is that I remember him saying his girlfriend works in courts, which worries me because moneyclaims county court is in Northampton, which is also where he lives!!!!so he could just cheat in various ways to win the claim!0
