Right, I got his defence letter today, he has said that paypal reversed the payment but it did not transfer into his account, instead his account also became negative like mine, and on the 30th of december he restored his balance meaning that he paid. So this may have been a paypal mix up and paypal may have the money on their account.0

But why did Paypal reverse the payment? Because he asked them to, I presume! Everything else is Not Your Problem.Time is an illusion - lunch time doubly so.0

you haven't been paid. you have told him you haven't been paid. its up to him to get the money to you, not for you to go looking for it.

First time I have seen this thread. The small claims court is a very simple and very informal affair. It has nothing whatsoever to do with the Police or Criminal courts. It really is as simple as one allegedly learned person and very often a clerk, listening to one side of the dispute and looking at their version of events, and then listening to the other side. Questions and documents are looked at and questions asked, it isn't a Crown Court affair or TV land court of "I put it to you etc "
Very simple and not frightening, I doubt that any alleged "recordings" or similar could be played and really it is a case of sticking to facts you can prove, which in this case is very simple. Something was sold and delivered, but wasn't paid for?
Don't lose sight that the individual involved is purely playing on your good nature and naivety. Don't lose heart and there really is no further point in any more phone calls or texts etc, wait for your day in Court and do not be afraid to stand up for yourself. YOU are in the right but unfortunately in what used to be a Great Britain the wrongdoer's shout the loudest and receive the greatest help. I do work in the legal system and can assure you that you will have your say, it is just whether the other person then pays up after judgement.
I would certainly block the phone as you are still the legal owner of the phone as you have not yet relinquished ownership as payment has not been made. Good Luck0 -
