    Yes Ashy, ebay owe you the £7.60, and in my experience, they just roll it over to the next month, so if you list anything else it comes out of this money.

  • Personally I wouldn't take a cheque, let alone one which is forward dated (Did you know this is actually illegal?). I would want a PO, Bank Transfer or Paypal although with Paypal you are back to square one as he could try to claim a chargeback again.

    Could you ask for a bank transfer instead? You only give out the same details as is on your cheque and so its quite safe. It might mean a few extra days wait whilst he gets paid but I think it might be safer all round and easier for both of you.

    It may be your nature, but personally I think you have been way too soft with him and he has taken you for a fool as far as he can.

    I would of been round his house within days of him starting playing games. :D

    Yes I would ask him to pay your costs so far for the action you have taken as even if you cancel your claim (IFhe does pay you which to be honest I very much doubt!) you will still have to pay for the service so why should you be out of pocket?

    You need to keep the claim going in the court, this joker has no intention of paying, He is hoping you will stop the claim before he sends the "Alleged" cheque. I have just spent the best part of an hour reading all the posts in this thread - through out he is making false claims - not one part of his story is coherent, it chops and changes - any court will see this and will find in your favour. I have taken companies and people to the small claims courts a couple of times in the last year and it not frightening, just you, the judge and the other party sat round a table, if you tell the judge what you have said here you are home and dry. Stick to your guns and don't play ball with the scum.

    Cheques can be used fraudulently and you have problems in that 'clear for funds' doesn't mean clear against fraud.
