Ashy, you're panicking again! You have no evidence his gf works in the courts, and, even if she did, it would make diddly squat difference to your case. She'd be up to her ears in proverbial if she tried to influence another court case.
Don't let him panic you about recording phone calls either. It's an empty threat.
He's going on about his ill mother again, but isn't he busy making eBay transactions all the time? Don't confront him with that - just reassure yourself that he is just lying through his teeth.
All you have to make sure is that he has a clear route to pay you the money he owes you (including the filing fee) - presumably a cheque to your address. You need have absolutely no more communication with him than that. Make that clear to him via an eBay message (i.e. much more easily provable than email) and then refuse all communication with him.
Oh, and by the way, someone said something about a cheque being OK once it's cleared. It has to do more than that - I think the phrase is "given value" - you have to talk to your bank to make damned sure that it won't bounce before you close the matter.Time is an illusion - lunch time doubly so.0 -

The worry you have about having recorded conversations - don't worry about it.
The only thing that could happen would be that the judge would say you can't use them directly because you did not ask permission. However, I am sure you could say things like 'in a phone conversation on such and such a date, the buyer stated....'.
Really, stop fretting. The fact is, somehow this buyer reversed money he had paid you by paypal: regardless of how that has occurred, ie an error with his bank and so on, you are out of pocket and it is down to him to rectify that. Stop answering calls, communicating by phone full stop, but keep a record of emails and so on.

he's really getting on my nerves now and I really can't be bothered, wish I'd just asked him to send me the phone back, I may have to travel to his town to attend court.
just logged on today onto money claim and found that he has not admitted that he owes me money:
"Defence
You are unable to take any further action online on this claim.
The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."
