Help!Buyer constantly delaying payment

    well if it was my phone and he hadnt paid for it, id be wanting to stop him using it. plus realistically, how quick is this online claim thing going to take AND if it rules in your favour he could drag it out for months before paying....

    the odds of him either returning the phone to you in working order OR paying in full the day after any sort of judgement against him are very very slim.

    he is a thief and he is happily using your phone. if a thief stole your car and you had the chance to at least take the keys off him would you not do that?

  • well here's how I see it, I am using the online claim to ask for payment for the phone, if I block the phone then in the court he will say the phone does not work since its barred and I will say yes I barred it a few days ago since he did not pay for it, then they will say since it was his phone, even if he hasn't paid for it, I did not have the right to barr is and because if the buyer pays the money then he won't have a phone!coz its barred.

    The example of the car and the keys that you've given is a thief stealing it, and you taking the car keys is different since you can hand over the car keys once he's paid but I can't unbarr the phone once he has paid, I will have to get a new one. It would be like destroying the car rather than taking the keys away and asking the insurance company to give you a new car which will have alot of paperwork and will have a negative effect on your record.
  • See what you mean there, I guess you could say that you could have indeed blocked the phone but didn't as you still hoped the sale would go ahead in good faith. Frustrating though.

    What do I do now, do I click the close dispute button? will that get my final value fees back or will I have to wait untill the buyer pleads guilty and closes the dispute himself?

    there has been problems with my paypal account, i have tried contacting the seller numerous times
    however he says he will not speak to me!! the phone is now faulty, i have paid via paypal, and i am
    disputing the transaction

    I believe you can close the dispute, just click that you no longer wish to communicate with the buyer.

    Below is proof that the transaction was reversed,once item was sent,I have all e-mails,text messages
    and online conversations with the buyer even saying there was a bank problem.The phone was brand new
    with warrenty I have contract proof.

    I contacted the buyer many times however everytime he made a new excuse why he has to delay the payment
    ,and did not mention any problems with the phone until I took action since there is no problem with
    the phone.The phone came with 1 full years warrenty which would cover any problems, my listing also
    said no returns. I have made my claim and if the buyer does not plead guilty he will have to pay all
    extra charges which could be enormous, I have enough proof to make this an open and shut case.

    You can also see from the buyers history that he buys and sells phone after he has used them, I have
    proof of him saying that he uses the phones and sells them off after a month since he just likes to
    try them and can't find a good one. In this case he has used the phone and now instead of selling it
    for slightly cheaper he thinks he can send it back having used it for almost a month.

    After I found out about the payment reversal I tried to contact the buyer but no answer until I left
    bad feedback, he claimed he needs to sell his LG phone on ebay and he won't be able to with the
    negative feedback that I left so I withdrew it, he sold his LG phone and now he still hasn't paid.Again
    ,I have proof of him saying all of this. Since I could no longer leave neg feedback he thought nothing
    will happen if he doesn't pay, he is trying to take advantage knowing that this is my first sale.

    The phone was sold on the 4th December, and since the buyer did not pay for more than 20 days, following
    many attempts to contact him and his many excuses for delayed payment such as family problems, I was
    forced to give him 24 hours to make the payment during which time i cut contact with him since he was
    only going to make more excuse and would not pay.After 24 hours, he still had not paid thus I was
    forced to make a legal claim against him.

    The way this buyer tricked me into removing the feedback was saying that he worked for the bank and
    that his partner worked at the courts and that they are both trust worthy people. I have this
    conversation recorded on my phone which will work against them if any of it is untrue.
