Help!Buyer constantly delaying payment

  • If i started to recieve phone calls from someones "Family" demanding that i pay for an item that i have no intention to, i wouldn't be scared, i would be convinced that the person had no idea what they are doing and were trying to scare me because that was the only way the seller new how to deal with it. I would feel that i had gotten away with in and just had to wait until the "family" got bored and gave up. However if i a single phone call saying in a confident and matter of fact way that i would have to pay by the end of the week or the seller was lodging a claim in the small claims court and then didn't hear anything until that claim ended up in my letter box i would be worried and would think that the seller was more experienced and serious then someone that was just calling me over and over, getting upset and demanding payment.

    I suggest you do not give any number away for people to pretend to be family. Deal with this with a cool head and deal with this rationally. Cease all contact and put in a claim and let the courts deal with it, it sounds like an open and shut case.
  • I have put the claim through, I even claimed interest even if it isnt much, it was only 30 pound for the fees. Now I'll just have to wait and see what happens.wish me luck...
  • Best of luck, definately. I've read this thread with interest, its about time people start to realise they cannot get away with whatever they like just because they feel anonymous over the internet.

    the fees are £30 to issue a claim,
    then if they don't pay up, it's another £30 to issue a warrant for a baliff

    thats when they get the CCJ

    i'm currently doing this to some 'nice' bloke that took £70 of mine, and dissapeared till i issued the claim 4 months later,
    after more months of excuses and missed promises to pay, i filled a warrant!
    money saving my @rse.
    I've spent 10x as much as I would if I had never discovered this website :-)

  • What an imbecile! I wouldn't engage in anymore conversation with him, by phone, by msn or anything. Let the small claims do its work i reckon, I'd print out everything you have from the transaction including that msn conversation, you never know what you might need to provide.
  • He is going to claim the phone was faulty. I can support my case in a number of ways, I have a text message from him from 2 days ago saying he will pay and had not mentioned anything about the phone, my contract with the mobile company I bought the phone with prooving that it was brand new. Any other ideas how I would support myself against such claim?

    Secondly how can he make a claim to paypal they aint invovled now.

    Let the courts sort it out
