If he can't pay for the phone immediately, then he should send it back. You are not a charity or a credit provider!

I'm sorry, but if he can't afford it, then he shouldn't have it.

Do not be made to feel like you are the one being unreasonable - because you most certainly are not!!
  • no there is no phone in getting the phone barred just yet, after all he might have sold it on to someone else, and from his previous history on ebay you can see that he buys and sells phones alot.If I barr it, some other poor sole will have trouble.I have now txted him saying "Hi, discussed it with my dad and he said I understand your problem but if the payment is not made within 24hrs, he will take action on my behalf"
I have also turned my phone off and blocked him on msn and will not answer any phone calls to my house that I have never seen before.
  • ok, can some one find me an extract from the ebay terms and conditions that when a buyer bids for something he must pay etc... so I can txt it to him, since he txted me back saying
" Go for it! See you in court! Or ill tell you what ill send the phone back"

    to which I replied
"I am not having anything do to with this anymore, my dad has taken over, bye"

    then he txted back saying
"Id love to talk to him, so if you want to give him my number would be great!"

    and I txted back saying
"he has told me not to have anymore contact with you since he does not see any reason for it, only for you to make more excuses, I wont be replying to anymore txts until payment"

Please dont tell me that last text was a big mistake, telling him I won't have contact with him, and that it could be used against me!

To be honest, I don't think he will pay and I will have to file a case against him. Any chance any of you guys can talk as my dad just incase he starts getting threatening and asking to speak with my dad?!

    Hi mashy

File the small claims asap , it would be today if it was me.
I cant see you getting your phone or money back any other way.

If he does get threating keep all texts and go to the police.

When the call is in progress
press the options ( left hand side button ) its in there to record.

Use this so you have a record of whats been said so you can use it to write it down on you claim

That sucks mate and unexpected too from someone with pretty good feedback. Its a pity you never removed the funds from the paypal account as soon as they arrived.I always do this at least you would have had the money in your account.

Ashy, sorry to read of this sad tale. :( I doubt you will get any joy, but let us know what the outcome is if you do go to court.

The moral, of this IMHO is - DONT USE PAYPAL for Selling. It is totally against Sellers and allows this kind of stealing to happen more and more. Stories like this just prove to other thiefs how they can do it!

Use a SECURE online payment like https://www.nochex.com, or https://www.pppay.com. No chargebacks...

Paypal is not under the FSA...pppay and Nochex are. I've had no problem at with either of them.

Sign up now ditch Paypal and keep your money when someone pays for an auction!!
