Help!Buyer constantly delaying payment

  • Ah yes, uunauthorised use. This is the same email I got as well AND I have seller protection. But you are only covered if you use Special Delivery. Some people are out to con others, they get thrown off and open another account, plus you have left your feedback already so you cannot neg him now. You can however claim your final selling fees back under the dispute section so make sure you get this started as well. I forget to mention this,

  • So to summarise this is what I am going to do:
    Tomorrow when I talk to him and he decides not to pay I will tell him he has 7 days after which I will file a claim against him. Then if he doesnt pay in that time I will file a claim using this https://www.moneyclaim.gov.uk/csmco2/index.jsp and then see where that takes me.And also get my final selling fees after 7 days.
  • I just remembered an alternative, the phone I sold to him, I had bought on contract yet I did not need the phone. It has 3 months free insurance, I could tell the carphonewarehouse it was stolen but Im not very good at lieing and dont really know what they will ask me. Forexample they could say, we can see the sim card is still active etc...has anyone ever gone through a phone insurance claim such as this?
  • I wouldn't advise that and furthermore, its against the rules of this site to discuss illegal or fraudulent activities. However, I would certainly recommend that you ring the contract provider and see if you can get the phone blocked and barred. That may give you some small satisfaction while awaiting the outcome of your small claims court claim.

    the buyer has your phone and your money. he has no intentions of paying. i wouldnt give him seven days, and i wouldnt tell him what you are planning on doing.

    I would text saying something like, can you please ensure you make the payment within the next 24 hours and leave it at that. then 24hrs later get the phone blocked and barred - tell the provider you don't know where it is and don't want anyone finding it and using it (which is true!), that will get them to block and bar it., and immediately file the small claims thingy.

    this buyer is having a laugh.

    I have to agree it is stolen as the buyer hasnt paid for it.

    Its a good idea to get the barred from the service provider

    I would tell him that if he doesnt pay within 3 working days from now, then you are going to get the phone barred, and if he still doesnt pay then report the phone as stolen or lost (but i wouldnt tell them the real situation).
    You have given this guy more than 3 weeks to pay, hes just trying it on so i would do all i could to get my money....after all it is over £200 worth!

    morally the phone is stolen however i wouldnt use that word with the service provider. also as above do NOT tell them the real situation.
