We're in a similar situation, except that our formal notice has now expired so I will start issuing proceedings this evening.

By the way did you send the formal letter to thei admin offices as I sent ours to the company's registered office as any action would be against the company? Other than that question, make sure you've got copies of all correspondence and if you are able to any evidence of e-mails tht you have sent.0 -

The deal I went for was a mobile phone connected to the Three network.
The £35 charge that P2U are insisting on charging me is for disconnection of the service - however I called Three yesterday and apparently the dealer (P2U) has not even applied for connection and therefore the new mobile is not connected. This is why I am disputing the 'disconnection' charge - what are your thoughts?

Sorry....I forgot to mention that I was also told by Three that they do not charge P2U to disconnect the service and so David Byfields (P2U customer services) claim that they are simply passing on the cost is untrue!0 -
I finally got a cheque for the first installment yesterday! This was after numerous emails/faxes/letters to them, and the promise of small claims action. I didn't go through with the small claims in the end but I would say it could be a good way of getting your cash quicker. My first installment took 3 and a half months.
A question: why are we penalised (like Mr Shah) for breaking the T&C's when they are non for clearly they break the T&C's themselves when paying out the cashbacks after the 28/45 days stated in their own documents?
I submitted my 2nd claim on the 20th November and was hoping that both cheques came at the same time...... no such luck though.

I haven't had the time to chase them up about my claim yet. I've sent an e-mail to the cashback dept and am now wondering whether I should just go straight for the court action.
Any suggestions??

I think they must have severe cash flow problems
Each claim seems to be ignored
Then I remind them - several times
They send an excuse
1st cashback 4 months after claim
2nd now nearly 2 months overdue
3rd about to be submitted
Don't use them!
PS O2 have given me virtually free 12 months when I tried to change contract to PAYG - £6 per month for 15 mins and 15 texts with a starting credit of £75 - which will pay the £6 for a year.0 -
Phones2Udirect are clowns. They wont pay cashback whatever you do/dont do. Im seriously considering another small claim.0

Many, many thanks (again) to Reestit Mutton, who kindly PM'd me the teext of a letter to use to P2U, requesting my £30 court fees.
I was in two minds about whether to try to get it back, but decided that for the price of a stamp and a piece of paper, it was worth a go.
I have now received my £30 "as a guesture of goodwill".
Thanls Reestit - just hope my next instalment comes through ok . . . .0
