I am thinking of submitting a claim to the small claims court against Phones2udirect. My details:

Phone Connected by 02 on 21/02/06
180 days later = 20/08/06
A bill came from 02 on the 22/08/06 and so this was my first invoice after the 180 days and so this was the invoice I sent to phones2udirect to claim.
I sent the 02 bill on the 30/08/06 and it arrived recorded delivery on the 31/08/06.
I have continually sent emails, left voice messages, sent a fax but not one word of response was gained from them.

I will start proceedings on Monday 13th November, and will keep you posted.
My 9th month anniversary is on the 22nd November!!!!

Is 22/08/06 the date you RECEIVED the bill from O2 or is that the date of issue of the bill?
T&C from their website says:
N.B. For clarification the 6th month’s invoice is classed as the first invoice issued after you have had the phone for a period of 180 days from the date of connection (inclusive).
I think they want a bill with issued date after 180 days of connection.

It's the date on the top of the o2 bill, so I am taking this as the date of issue of the bill. I usually get the bill around the 23rd every month.
I've had enough of these Phones2udirect people and I don't mind spending 30 quid on giving them a bit of hassle via the moneyclaim/small claims court!

I am also thinking of submitting a claim to the small claims court against Phones2udirect.
My phone was connected on 10/03/06 by O2 and I received my 6th months invoice in September). I sent my original invoice from O2 along with a letter requesting the cashback recorded delivery. This was recived by Phones 2U on the 19th September and have not herd anything from them since.
Under the T&C from at the time of purchase cashback applications will be processed within 28 days of the date of receipt, this would be the 17th October. New T&C state cashback claims are paid out in the form of a cheque, which are sent out within 45 days of receipt of a valid claim, this would be the 3rd of November. I emailed them on the 29th October & 6th November asking them to confirm receipt of my cash back claim and informed them if that if I had not received a satisfactory reply by the end of this week I would start legal proceedings in the small claims.
I have two phones on this contract so stand to loose a substantial amount of money with these people if I do nothing. Is it too early to start a claim in the small claims? I have also managed to get hold of a copy of the T&C (Version 3.0) that I think where current at the time of purchase that is 10th March 06, can anyone advise me if this is correct?

I got this this morning. I replied saying I will wait till the end of the end where I would make the claim to the small claims court and phones2udirect will incure the costs. Has anyone else got this msg b4 - and how long was your wait from this msg. Thanks!

Well, I got that self-same message a month ago - still waiting! After I got that message, I stopped receiving the auto-reply from them - now I wonder if they somehow blocked my e-mail address so they could claim non-receipt of e-mails as well as snail mails.
Anyway, I am starting proceedings via the small claims court this week, we'll see what happens.0 -

Welcome to MSE.
You have the wrong T&Cs.
V3.0 was only valid until 01 March. From 02 March until 16 May V3.1 was in force.
If you drop me a PM including your email address or, better still, drop me an email via my website (you can find details of it via my profile) I will be only too happy to email you a copy of the V3.1 T&Cs - make sure you study both V3.0 and V3.1 carefully to identify the differences that exist before sending in your claim.
