    I need some help!

    The phone I have was connected on 23rd March 06. 180 days from this date is 19th September 06. The first bill after this date was issued on 24th September 06.

    I sent this by special delivery (and have the slip to prove it) within the 14 day period. I have still not received payment.

    I am considering using the small claims court. Before I do so, could anyone confirm whether I have made a mistake.

    If someone could forward the example letter detailing small claims court action, I would be very grateful!

    My claim was due in September and I've only just been sent a cheque.
    I did email them via their website threatening the small claims court:

  • I got my second claim paid a couple of days ago. I emailed them about two weeks ago threatening legal action. I told them I would do everything possible to stop others using them. After about two weeks my second cashback arrived. I sent the claim in 12th September, so it took over three months in total (what a surprise).

    Thanks for the update!

    Think I may have to write that aggressive letter! Just 101 other things to be doing - oh well, it'll be worth it if it works.

    Would you know if there's a standard template anywhere on this website that I could use - feeling lazy!

    I have done the same mistake by sending the cash back claim to phone2udirect with the sixth bill, instead of sending the bill received after 180 days.My question is that should i send the next bill with a covering letter which will come around first week of Jan 2007 or wait for their rejection letter...my date of connection was 28 June 2006

    In your case - don't wait! They will reject any claim if it's late - just ignore the wrong one you sent and then send the correct one when it's due.

    You won't hear from p2u until it's too late :mad: - it's the way they work.:eek:

    With these cash-back schemes you MUST calculate which bills to send as soon as you take out the contract. Then write it down as a reminder on a wall chart or wherever you put appointments.:T

    PS the second cheque has recently arrived - only 3 months after I claimed it!

    Many thanks for your advice....but the problem is if i send a new claim after the january bill..they can still reject it by giving the reason that there was no original despatch note...as it is already sent and i have only a photocopy..any comments on this will be appreciated..thanks again

    Ah - I didn't think of that - sorry.
    I'd suggest you enclose a copy of the copy and point out that they already have the original.
    Keep copies of all communications and send everything recorded delivery - it costs £1.

    Make sure you read your terms and conditions carefully and comply with every little twist and turn of their requirements - otherwise they will reject your claim, and all subsequent claims.
    Not a friendly company to deal with.

    Doesn't rally matter what you send - they never pay anyway until you threaten them with court action :-(
