i sent the bills after 153 days but i doubt they'll send the bills back to me. Did anyone watch this feature on BBC news24 this morning? Seems that all companies are doing this.
I think i will make a claim against them on setting impossible contract conditions!!!

you still have time then as 180 days must be about 14 jan. you send the complete bill you recieve after that date with all the other information they ask for. ie order number phone number & say you didnt receive an invoice from them in the 1st place so can only quote the number, you should have that from your online order.im sure that saying you havent got it would be fine in court as you can have a paperless order. & they state that proof of posting is not proof of receipt so maintain it was never there. if they then say it must of been as they already had it from you, well thats fine then as they have everything.
or you could say they already have it & quote your recorded delivery date & ref.hopefully you didnt just post it normal post. if you did stick to never having recieved it.
dont forget send it special delivery.
below should be the relevent part of the T&Cs
"To claim each instalment you will be required to send us the complete original postal invoice from your network for the month you are claiming for. This must be received by us within 21 days from the date on the invoice (inclusive), along with a letter detailing your full name, address, order/invoice number (from ourselves) and the mobile number you are claiming for. Your first claim should also contain your original purchase invoice received at the point of purchase, unless it has already been sent to claim an electronic gift. These items should be sent to our address as below"

Hi all,
I've been one of those people with P2UD that is refusing to give up. It finally worked with my 1st payment after like 3 months. My second bill was sent at the start of December and so last week (after 45 days) I sent my 'reminder' email and got the automated reply. This week I sent another one and there was an additional line on the automated reply:
"Additional Information
Please note that the next cheque runs will commence from the 23rd of January 2007."
Could this mean that by next week I'll get my cheque. It's the first time I've seen this line on any of their responses.

I too have had my claim rejected on the grounds that I should have sent my details within 14 days and not 21. I have challenged the change in terms and conditions as unfair as there is no way to retrospectively find out which T&Cs applied at the time you enter into a contract. I think this whole approach is designed to confuse and frustrate the consumer, and cheat them out of their rightful cashback. I believe the T&Cs contain unfair clauses under the Unfair Terms in Consumer Contratcs Regulations 1999 (see OFT website). So what am I doing?
1. Complaining to trading standards
2. Writing to Watchdog
3. Writing to MoneyBox(Radio4)
4. Writing to Guardian Money
5. Writing to WHICH?
6. Taking out a claim in the County Court
...all simultaneously !

The claims window is 14 days for versions 3.0 & 3.1.
P2U increased this to 21 days as of version 3.2.
IN ALL cases you should provide your full original invoice for the latest month along with a cover letter to include your full name, address, P2U order/invoice number and the mobile number you are claiming for.
It's only in version 3.2 that they spell out exactly what you should state in your cover letter. I would like to think that they aren't using this as an additional means of reducing the success rate of their customers' claims but in this industry you learn to take NOTHING for granted.
Anyway...if you want a copy of the relevant T&Cs, simply PM me your email address and I will be only too happy to oblige.

When I asked P2U, they told me that version 3.3 of the T&Cs came into effect from 25/05/06; where did you get your dates from?0 -

not quite sure why you would challenge the change as unfair? they increased it not decreased it. surely you made a copy of the T&Cs when you took the phone.if not i dont think saying "when i looked at the T&Cs some 5 or 6 months into the contract it said 21 days" would work in court.
if your connection date was after 16 may, you had 21 days.0 -

You're absolutely correct browncrow - my info was from the MD himself and, looking back at it, he does state that V3 commenced on 25/05/06.
I'll change the original post as well so as to prevent others from being misled.

This is indeed a miracle to get my 2nd cashback back when they had initially sent me a letter of refusal saying that my cashback was rejected as I had sent my bill early.
Recap : I had sent bill 9 / 10 for 2nd cashback ( reaching before 14 days) by recorded delievery. After 60 days I got a letter saying that my cashback is rejected becuase I had the bill sent early. I sent a warning letter saying that they cannot refuse me unless they havent recevied my correct bill as no where written in T and C. They did not reply for 2 weeks inspite warning that I would take them to small claims court. No reply till 2 weeks , and I send them one more reminder.
After another 2 weeks - no reply from them and I was just about to file claim , BUT in my POST i got a cheque back cheque.
In short keep writing to them if you feel you are right and they should give the cashback.

Abeezar - I doubt you would have much of a case if you took the legal route....what was your date of connection and when was your first bill issued? You should check that you did send the bills early, although I'm not sure how this can happen as you have 14 days from bill dates to get claims in to them. Post here or pm me and we can work it out.
Garetha - I've only used mobileshop previously. The would send a txt and e-mail to say that the claim had been received and when payment would be sent out. They were late (by two weeks) once but no real problems. To be honest, I think they all make it difficult but as long as you follow the T&C's completely, you shouldn't have a problem. Also go with a company that is established and therefore unlikely to be liquidated in the near future.....good luck!

I am now in my 10th month with phones2udirect. I have send 100's of emails to both addresses: claims@phones2udirect.co.uk & cashbacks@phones2udirect.co.uk, even used both personal email address as well as my work one.
They have been totally useless. It takes forever to get a reponse and even then when they reply, they don't answer my question correctly.
Basically when I bought the phone I sent sales an email to clarify what I had to do to get my money back. They replied by simply saying, all you need to do is send back your 6th, 9th and 12th month invoices back.
So I sent my 6th month invoice back and then after constant chasing they told me that I was rejected as it was not the correct one, they wanted to the 7th month bill. I have faxed bills 6,7,8, 9 and now 10 !!! I have argued with them now for months and not getting anywhere. Even 3 the Network have siad to avoid these type of deals (although I did one last year with Carphoneware house and had no problems at all). My next stop is to take legal action and take them to a small claims court, thanks to a link in this thread.0 -

I have filed for a County Court Claim No: 7QZ17431 against phones4udirect, as this is now my 10th month and they have very rarely contacted me and when they have they have given me totally bizarre reasons as to why I have been rejected in making a claim.
The claim is for 2 Cashback cheques they owe me for months 6 and 9 for a 12 month mobile contract I took out from them.
STAY AWAY FROM THESE GUYS!!!!
