    I have just received my first cashback instalment yesterday after threatening to take Phones 2U Direct to small claims. After sending many letters and emails that where ignored, I sent the following letter along with my second claim, recorded delivery on the 18th December.

    I write with regard to the above accounts. Letters have been forwarded to your offices by recorded delivery which to date you have chosen to ignore. Under your terms and conditions, I expected to receive payment according to the timescale quoted. Unless I receive payment for the first cash back claim by 5th January 2007 I will then initiate court proceedings.

    I have two phones on this contract totalling £60 a month including vat, unfortunately the cheque was only for £240. By my calculations £60 x six months totals £360, has anyone seen a limit on single cashback payments and should it include the vat.

    I think you get 4 months at a time if you check your t&cs
    so 4 x 60 = £240

    Just make sure you don't miss each deadline - write the dates down NOW!

    I have finally sent a 'special delivery' letter threatening court action if payment is not received within 14 days - payment was due by October 31st.

    After my experince I would never recommend phones 2u direct to anyone. I sent off my first cashback claim in Sept. Waited, heard nothing then emailed them again heard nothing. Finally sent them a recorded delivery letter in November asking for my money within 2 weeks. Finally got a reply on 23 Dec stating they had no trace of my claim, that they do not make mistakes and that they would not be paying any cashback for the contract.
    DO NOT TOUCH THIS MOB WITH A BARGEPOLE.

    Did you send the claim by recorded or special delivery. If you can prove that you sent it, threaten legal action - I'm sure they will reconsider their stance!
  • Hey just wondered if anyone could help me whether or not i could have a case to go to the small claims court or not.
    I bought my phone back at the end of may last year on a £30 a month contract with O2 from phones 2udirect and what I believed to me my sixth month bill I sent off on the 10th of November. From that time while I was worried about the progress of my cashback so I continued to ring them in the 2/3 weeks following me sending the letter. I then recieved a letter saying it was a bill to early and my cashback claim was rejected and convieniently it was sent on the 21st of december, exactly the alloted time they allowfor you to send the correct bill. I tried to contact them when there was enough time for me to send the right one... but as many have you also found there seems to be no way to get in contact with them. I have emailed them again ask why they took so long sending the letter to me (approx 6 weeks) and they sent me the same thing as the letter. What should I do next? Is it worth going to the small claims court?

    My 2nd cash back claim has been rejected with the reason that I have sent the bills early.

    I send the 9th and 10th Bill - and got a letter that I have sent a bill too early ( 9th Bill) and therefore my cashback is rejected. This was sent to me after I sent the 10th Bill.

    I plan to go to smalls claim court and what do you think I have chance to win.


    You advice will me much appreciated.

    No I didn't think it neccesary as I've had cashback contracts for the last 4 years and never had any bother. I'm not sure how a court would view the fact that I do not have any proof of posting, except for copies of the letter I sent with the orig cashback request.

    Hi Garetha

    I've used both e2save and carphone warehouse each twice and a friend has also used carphone warehouse with no problems.
