Hello Reestit,
I too, have had the problem where Phones2u are declining the cashback in the event of not claiming within 14 days of the appropriate invoice date. Unfortunately, i was going by version 3.4 T&Cs'which states to claim within 21 days.I was not switched on enough to realise that these would change, so, Reestit, i will also be asking via your website if you could kindly forward me the v3.1 T&C's(as my contract started on the 16th March.It's especially frustarating as i re-read the terms over and over making sure i wouldn't get caught out, we live and learn!

I have a cheque from Phones2uDirect for my outstanding cash back!
I ended up putting in a claim via MoneyClaim, but they sent the cheque after they'd received the notification, but BEFORE it was deemed to be served, so I'm not sure where I stand on recovering my £30 claim fee, but at least I have my cash back.
Many thanks to Reestit Mutton for sending me a copy of the relevant T&C's - I was pretty sure that I had complied with them, but not quite confident enough to go to court until I received the mail from RM, so thanks again for that.
Now, if I could only get my £30 as well .....0 -
It's been a nightmare so-far having to send and resend emails, online forms, faxes, recorded deliveries, etc to these chumps every week or so with threats of legal action etc.
My 9th month anniversary is this week and I haven't received my initial cheque as yet! I've got 2 emails since my claim on the 30th August (the last one said: "According to our records this is going through the final stages of processing now" - so fingers crossed it'll come soon.
I will send my 9th month bill to Phones2udirect again (by recorded delivery) and I'm presuming that I will have to fight tooth and nail again for this claim and then the 12th month claim also!!!!
I may go through moneyclaim as soon as the breach of contract exists and then hopefully they will pay promptly.

The claim sent out correcly as per their terms and conditions have been rejected with the reason that because the first claim was rejected, all the remaining claims will be rejected too.

I can understand why they make it difficult - but it's not good for their image0 -

I recently took out a second contract with Phones2udirect.
Things are not looking good - they tried to deliver the phone later than they promised and they're customer services are not polite.
This, in addition to the fact they are now overdue in sending out my first cash-back cheque has led me to want to cancel this new second contract.
I now have a return's number and need to get the phone back to them by Monday 4th Dec in order to qualify for the 14 day rule. However as someone has previously mentioned, there is an admin fee of £35 payable which I do not want to pay.
I have spoken to trading standards (aka consumer direct on 08454 040506) who say that according to the Distance Selling Regulations, no 'admin' fee is payable. The twist is that P2U are saying they will not cancel the contract unless I put in writing that I agree to the £35 charge. I know it's not much but why should I pay?
Any advice would be really appreciated.

I sent in my claim in October and they wrote back saying the envelope was empty. i sent copies of all the documents again but they are not letting me know what they are doing to my claim. It is now over 28 days and as per terms they should have given the money or an answer. I just sent a 14 day formal notice asking them to sort the issue by December 15 or I will take them to small claims court.
Any advice if i need to do anything else.0 -

I'm not sure it's as simple as this. Under the distance selling regs you have 7 working days to return goods (from the day they are received) and seven working days to cancel a contract (which runs from the day after you entered into the agreement), so I don't think any cancellation in this case falls within those regs. In that event you are left with the fourteen day period that 02 provide for cancellations and I suspect you will have to pay the admin as this is contained within the pages on the Phones2udirect webpage, although it maybe worthwhile speaking to 02 to get their view on the charge.0
