Cheers. I'll get the letter in the post Monday morning then.

I keep looking over the T&Cs and recalculating my dates 'just in case' it is me in the wrong. Every calculation comes to the same conclusion - I'm well within my T&Cs.

My only grey area is my connection date. My first bill shows 31/07/06 as the earliest date - and that was the day my phone was received.....therefore I assume that is right. Anyway, it would have to be out by a fair bit to mess up my 180 day calculation.

Sorry to keep going on - I'm just so mad that this is now going to take up my time and energy to fight them. Grrrrrrrrr (my husband did warn me back in July!!!)

All your calculations look correct to me, your not alone so its the best place to let your anger out. And for any other people who are considering cashback deals I find doing something like this to highlight your cashback dates very useful.

Thanks - I did the same spreadsheet.......and used this program to calculate the dates

    http://www.timeanddate.com/date/dateadd.html

But despite laying all of this out in my letter to P2UD - they still said I was wrong!!!!!!

  • A further question!

If P2UD do not pay-up and back down.........do I claim for my full 12 months' worth of cashback from county court, since they say I am not entitled to claim at 9 and 12 months due to my 6 month claim being wrong?
I do not know if you can claim in advance for this amount? I will certainly be also claiming for interest lost (it says you can on the small claims website!)

Letter is written, and all documents gathered ready to send tomorrow (by recorded delivery.......that should be suffice shouldn't it? I don't think Special Delivery is required for this? What do you think?)

Thanks for all your help - will keep you posted!

  • yes you should claim it all. if they wont pay the 1st they wont pay the rest.
recorded should be fine as long as you keep copies.but having said that, in the last 12 months i have had 3 recorded deliveries go missing & recieved 1 without having to sign for it.

Does anyone have the address of the local trading standards for P2UD and the name of a contact there that has dealt with them ?

Can you please state what address you sent the complaint to and what, if any feedback you get from ofcom and P2UD ?

    Thanks

Thanks for your support. I've just sent a complaint to Ofcom (just to get it off my chest!). I will send a letter disputing their decision (by recorded mail) and will give them 10 working days to respond before I go to small claims.

Does this sound the right course of action - is 10 days ok, or should I give them longer/shorter?

I cannot believe they are trying to get away with this. They are complete scoundrels!!!!!!

    Hi,

The Ofcom complaint can be done online using this page:
    http://www.ofcom.org.uk/complain/mobile/company/billing/formal/?itemid=316147

You will not receive a personalised response from Ofcom - they just collect complaints to monitor problem areas

With regards to my P2UD complaint, I am sending it to the address: Unit B4, Chaucer Business Park, Watery Lane, Kemsing, Sevenoaks, TN15 6QY

The Trading Standards Office local to P2UD is:

    Kent County Council
    Consumer Advice
    PO Box 71
    Ashford
    Kent
    TN24 8WB

    t: 08454 040506 (Lines open Mon-Fri 10am-4pm)
    f: 01622 221013
    e: trading.standards@kent.gov.uk
    w: http://www.tradingstandards.gov.uk/kent/

I will certainly feedback with any update - good luck in your quest too!

JodiMBrown - thanks for the reply - hope things go well for you - I'm sending my first claim off by special delivery tomorrow...

Just wondering, if you have a letter already drafted for this, would you be able to post a copy of it, minus all personal or other details you wish to omit on here. Seems like we could do with some letters that work - just like getting bank charges back !

Also, would anybody be able to do the same for the text they put into the small claims website - claiming for all remaining cashbacks and interest seems reasonable - but what did people write that worked ?

Thanks and hope you consider it...

Seems like there is an opportunity here for a website that scores mobile cashbacks based on reliability or other criteria, that would be very useful as soem of these can be good value if they work, but an awful lot of hassle if they dont.

I also wonder if we can write to the networks whose phones they sell with details of what they are doing and how it is tarnishing peoples experience and ask them to stop dealing with Phones2UDirect ?

Also - how long does it take to get a "sorry your claim is rejected" or better response from P2UD ? and do they send this as a letter to you ?

    Thanks in advance...
